DECISION: The City of Everett Planning Director grants APPROVAL for the proposed reasonable <br /> use application,subject to the following conditions below. <br /> CONDITIONS: <br /> 1. No buildings or additions may be placed within the 10 foot setback area between the proposed <br /> dwelling unit and the buffer. The dwelling must meet all other zoning code development standards <br /> except for the reduction of the twenty-foot front setback to 5 feet. <br /> 2. The proposed development footprint of the single family dwelling as shown on the site plan cannot <br /> be changed without the Planning Director's approval. <br /> 3. Comply with all the recommendations of the revised Critical Area Report by Wetland Resources, <br /> Inc.dated January 18,2017.This includes the planting plan,monitoring,and maintenance <br /> consistent with the approved mitigation planning plan and report.A site plan approved by Wetland <br /> Resources must be provided indicating replanting efforts per the planting plan within the buffer area <br /> to be restored.Monitoring and maintenance will be the responsibility of the developer under the <br /> direction of the ecologist.Inspection of the plantings is required when completed. Comply with all recommendations of the Geotechnical Engineering Memorandum dated September <br /> 12,2016.Monitoring and maintenance will be the responsibility of the developer under the <br /> direction of the geologist. <br /> 5. The plantings and other mitigation measures and the construction of a permanent split-rail fence as <br /> shown on the approved site plan must be installed or an assurance device worth 300%of the cost of <br /> planting and fencing must be provided to the City prior to issuance of building permits. <br /> 6. City of Everett Critical Area signs must be placed on the fence at the edge of the wetland buffer. <br /> Signs may be purchased from the Permit Services Counter. <br /> 7. Record a Critical Area Protective Covenant and a Geological Hazardous Covenant prior to issuance <br /> of building permits.A Critical Area site plan must be formatted to meet Snohomish County Auditor <br /> standards for recording.Request the covenant documents at the time of building permit submittal. <br /> Verify the documents are complete with the Planning Department prior to recording. <br /> 8. A Maintenance Assurance Device shall be submitted after an inspection of the plantings is <br /> completed.The assurance shall be no less than 10%of the cost of the planting material and <br /> installation. Forms are available upon request and they include posting a bond,setting aside funds <br /> in a bank account,or depositing cash with the City of Everett Treasurer in the City Clerk's office. <br /> 9. During construction, the site must be monitored by the Applicant's ecologist.Any problems, <br /> including any conflicts or violations of the sensitive area limitations contained in this decision must <br /> be reported immediately to the Planning and Public Works Department at 425-257-8810. <br /> 10.A temporary construction fence shall be placed along the construction setback line to prevent <br /> encroachment during construction per EMC 19.37.110.E. <br /> This is an administrative decision that is appealable to the City's Land Use Hearing Examiner.Any <br /> appeal must be filed with the City within 14 days of the date of this notice.
