t { <br /> (676' <br /> d. The Respondent shall maintain the property free of nuisances including <br /> discarded junk, trash, salvage materials and vehicle parts. Approved garbage <br /> containers with tight fitting lids shall be used to store garbage and refuse on the <br /> property. <br /> 3. The Respondent shall be fined $500.00 for each violation of EMC 8.20.020 <br /> (A)(E)(G), EMC 8.22.030 (A) and EMC 19.34.060(J) for a total fine of$1500.00. <br /> $1400.00 of the total fine shall be suspended provided the Respondent comply with <br /> item 2a-2d of this Order by November 18, 2016. If compliance has not been met by <br /> November 18, 2016 the suspended portion of the fine shall be due to the City <br /> immediately. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four(24) months. <br /> 5. The Respondent shall pay the $100.00 non-suspended fine no later than <br /> November 25, 2016. Payment shall be made to the City of Everett Treasurer at <br /> 2930 Wetmore Suite 100, Everett Washington, 98201. If payment is not made on or <br /> before November 25, 2016 collection action will be taken, which may include <br /> assigning the debt to a collection agency pursuant to EMC §1.20.050(D). <br /> 6. This written Order shall be controlling over any conflicts with oral Orders issued at <br /> the Public Hearing. <br /> 7. Any post hearing motions shall comply with the Rules of Procedure of the City of <br /> Everett Hearing Examiner for Code Enforcement which can be found on the City of <br /> Everett website. <br /> 8. Any appeal of this Order must be filed in Superior Court and be made within twenty- <br /> one days of the issuance of this Order and comply with the procedures set forth in <br /> Chapter 36.70C of the Revised Code of Washington.
