A <br /> portion of the City owned real property located at the end of and just east of Pigeon Creek Road may be <br /> needed by BNSF in order to make these safety improvements. Additionally, access to the work site by <br /> BNSF is proposed by the use of the City owned Pigeon Creek Road extending from Mukilteo Boulevard <br /> north to the BNSF right of way along Port Gardner Bay. <br /> The attached Resolution references the Agreement Regarding Option To Acquire Fee Parcel And Regarding <br /> Crossing Licenses and the Temporary Construction Agreement between BNSF and the City of Everett. <br /> Together these provide for the surplus and transfer of a portion of utilities owned property to make these <br /> safety improvements in accordance with the specific tenns and conditions as set forth in the agreement. <br /> Generally, if the property transfer and use of Pigeon Creek Road is to occur by BNSF, compensation to the <br /> City would be in the form of two future crossings of BNSF's right of way- a Utility Crossing and a <br /> Pedestrian Overpass Crossing. <br /> RECOMMENDATION: <br /> Adopt Resolution Regarding the BNSF Railway Company Pigeon Creek Slope Stabilization Project. <br /> 1 <br />
