w <br /> STAFF REPORT TO CITY COUNCIL <br /> ON THE PROPOSED VACATION OF <br /> that portion of the north/south alley lying <br /> north of Wall Street between Oakes and Rockefeller Avenues <br /> Report Date: May 11,2015 <br /> Said portion of the north/south alley right of way being legally described as: <br /> THAT PORTION OF THE ALLEY IN BLOCK 685, PLAT OF EVERETT, ACCORDING TO THE <br /> PLAT THEREOF, RECORDED IN VOLUME 3 OF PLATS, PAGE 32, RECORDS OF SNOHOMISH <br /> COUNTY,ADJACENT TO THE SOUTH 22.99 FEET OF LOT 1,ALL OF LOTS 2,3,4, 5,16,17,18,19, <br /> AND THE SOUTH 21.87 FEET OF LOT 20; <br /> AND <br /> THE ALLEY IN BLOCK 685, EVERETT LAND COMPANY'S FIRST ADDITION TO EVERETT, <br /> ACCORDING TO THE PLAT THEREOF, RECORDED IN VOLUME 3 OF PLATS, PAGE 20, <br /> RECORDS OF SNOHOMISH COUNTY, ADJACENT TO ALL OF LOTS 5,6,7,8,9,10,11,12,13,14,15, <br /> AND 16. <br /> ALL SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON <br /> The proposed vacation contains an area of approximately 5,931 square feet that is zoned B-3, <br /> Central Business District. <br /> FINDINGS OF FACT AND CONCLUSIONS OF LAW: <br /> FINDING: R.C.W. 35.79.010 allows property owners abutting a public right-of-way to <br /> petition for the vacation of said right-of-way, and if said petition represents <br /> more than two-thirds of the property abutting said right-of-way,the legislative <br /> authority shall fix a time and date for said petition to be heard. <br /> CONCLUSION: A valid petition representing 100% of the abutting property owners to the <br /> proposed vacation area was received, and 6:30 P.M. May 20', 2015, was set <br /> as the time and date for said petition to be heard. <br /> FINDING: R.C.W. 35.79.020 requires the City Clerk to give twenty (20) days notice of <br /> pendency of said hearing on the petition by written notice posted in three (3) <br /> of the most public places in the City, and a like notice to be posted in a <br /> conspicuous place on the right-of-way to be vacated. <br /> CONCLUSION: Said notices were posted as required. <br />
