t6 <br /> CITY OF EVERETT <br /> AMENDMENT NO. 1 <br /> The City of Everett and ICF Jones&Stokes,Inc.(ICF Jones&Stokes,Inc.)agree to amend and modify <br /> their professional services agreement dated January 13,2015(the"Agreement")as follows: <br /> WHEREAS,ICF Jones&Stokes,Inc.and the City entered into an agreement dated January 13,2015 to <br /> provide design and permitting services for the Smith Island Habitat Restoration;and <br /> WHEREAS,the City of Everett requires additional assistance in characterizing the soils at the restoration <br /> site as further described in Attachment 1;and <br /> WHEREAS,the total amount of compensation of$261,803 stated in the agreement is insufficient and an <br /> additional$30,000 of contract value is needed to perform additional work for a total of$291,803; <br /> - <br /> NOW—'TrHEREFORE;the—Ciiy-of Evereft=anctlCF-Joires&-Stokes;Ina agree-to amend-and-modify-the-- <br /> Agreement as follows: <br /> 1. Paragraph 4(B)is amended to read as follows: <br /> The City shall pay ICF Jones &Stokes,Inc. a sum equal to the amount of hours <br /> worked multiplied by the rates identified in Attachment 2 for the staff performing the <br /> Work, subject to the maximum stated in paragraph 4(D)of this Agreement. <br /> • 2. Paragraph 4(D)is modified to read as follows: <br /> Total compensation, including services and expenses,shall not exceed a maximum of <br /> Two Hundred Ninety One Thousand Eight Hundred and Three Dollars($291,803). <br /> 3.
