The amount for the Task Force 2009, 2010, and 2011 operating <br /> budgets for these purposes shall be similarly determined and subject to the approval of <br /> the Everett Police Chief. <br /> c. Continue to make such training and other resources available to the police officers <br /> assigned to the Task Force as would be available to other officers employed by the <br /> Everett Police Department. <br /> d. Refer all potential asset forfeitures initiated or investigated by the <br /> Everett Police Department narcotics officers assigned to the Task Force during the <br /> pendency of this agreement to the Task Force for disposition at the discretion of the <br /> Task Force or prosecuting authority(county prosecutor or United States Attorney). <br /> e. Use any assets forfeited under RCW 69.50.505 in accordance with RCW <br /> 69.50.505(i), which limits use to the expansion and improvement of controlled <br /> substances related law enforcement activity and prohibits use to supplant preexisting <br /> funding sources. <br /> 3. Duties of Participating Jurisdictions. The Participating Jurisdictions, acting <br /> through the Task Force, will take the following actions: <br /> a. Administer the Task Force and any assets seized or forfeited as a result of this <br /> agreement in accordance with the interlocal agreement between the Participating <br /> Jurisdictions effective July 1, 2007, or any successor agreement effective during the term <br /> of this agreement. As is currently the practice with respect to assets seized or forfeited by <br /> Task Force action, the Task Force Commander, under the direction of the Executive <br /> Board, shall manage the acquisition and disposition of assets seized or forfeited as a <br /> result of this agreement in compliance with law and Task Force procedures. <br /> b. As authorized by paragraph 5.3 of the interlocal agreement between the Participating <br /> Jurisdictions effective July 1, 2007, allocate forty (40) percent of the net monetary <br /> proceeds of asset forfeitures made by the Task Force to the City of Everett. <br /> c. Use any assets forfeited under RCW 69.50.505 in accordance with RCW 69.50.505(i), <br /> which limits use to the expansion and improvement of controlled substances related law <br /> enforcement activity and prohibits use to supplant preexisting funding sources. <br /> 4. Reassignment. This agreement shall not restrict the ability of the Everett Police Chief <br /> to reassign officers, provided that if the Everett Police Chief assigns fewer than the <br /> number of officers assigned by the Snohomish County Sheriff then the Task Force <br /> Executive Board may at its discretion reduce the percentage of forfeited assets allocated <br /> to the City of Everett under' subparagraph 3.b of this agreement. <br /> 5. Dispute resolution. Any dispute arising under this agreement will be referred to the <br /> Task Force Executive Board for resolution. The determination made by the Executive <br /> Board shall be final and conclusive as between the parties of this agreement. <br /> 6. Duration.
