cif ' ORDINANCE NO. 171'6 AN ORDINANCE REPEALING ORDINANCE NO. 1276 (ECC 13. 12) AND ENACTING IN PLACE OF SAID ORDINANCE AN ORDINANCE PERMITTING THE USE OF THE CITY SIDEWALKS FOR PURPOSE OF CERTAIN RECEP- TACLES HAVING PUBLIC UTILITY AS HEREIN DEFINED AND CERTAIN RECEPTACLES FOR PLACEMENT OF SHRUBS TENDING TO BEAUTIFY CITY STREETS AND SIDEWALKS AND PROVIDING FOR PERMISSION FOR THE INSTALLATION OF SAID RECEPTACLES, PROHIBITING ALL OTHER OBJECTS OF ANY SORT, NATURE OR DESCRIPTION TO BE PLACED UPON A CITY SIDEWALK, PROVIDING PENALTIES FOR VIOLATION OF THE ORDINANCE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF EVERETT AS FOLLOWS: Section 1 : That Sections 1 & 2 of Ordinance No. 1276 being Everett City Code 13. 12.010 and 13. 12.020 are repealed and in place thereof the following is duly enacted. Section 2: That a new section, to Chapter 13. 12 is enacted as follows, to-wit : 13. 12.010 Definitions: (1 ) "Sidewalk area". Sidewalk area shall be designated as that space on the public right of way set aside as the walking area for pedestrian traffic as shown and established on the records of the City Engineer as a sidewalk, and where the City Engineer 's records have not established such walking area, then "sidewalk area" shall be that space within the public right of way which is actually used as the walking area for pedestrian as distinguished from vehicular traffic. (2) "Objects". Objects shall be defined as any tangible article, and without limiting the gen- erality thereof shall include produce, goods, wares, merchandise, signs, racks, or any other article what- soever. (3) "Ornamental Objects". Ornamental objects shall be those receptacles or containers which tend to beautify the public right of way or city streets or sidewalks as may be approved by the City Council . Section 3 : That there is added to Chapter 13. 12 a new section as follows, to-wit: 13. 12.020 Objects on sidewalks unlawful ; exception: It shall be unlawful for any person, persons, corporations or other entities to cause to be placed upon any sidewalk area in the City of Everett or to permit to be placed upon or to occupy any sidewalk area within .the City of Everett any object of any sort or any article whatsoever except certain receptacles or containers approved by the City Council of the City of Everett.
