• , % <br /> Section 4: That there is added to Chapter 13. 12 a <br /> new section to read as follows, to-wit: <br /> 13. 12.030 Objects permitted upon sidewalk areas: <br /> With the consent of the City Council , upon application <br /> being made to said City Council , the following objects <br /> may be placed upon the sidewalk areas in the City of <br /> Everett under such conditions and in such manner as <br /> the City Council may approve, to-wit : <br /> (1 ) Containers for shrubs or trees. Receptacles <br /> or containers for shrubs or trees which tend to beautify <br /> the City of Everett. <br /> (2) Trash containers. Containers or receptacles <br /> provided for the deposit of trash or other refuse matter. <br /> (3) Telephone booths. Telephone booths installed <br /> under the direction of the telephone company authorized <br /> to do business in the City of Everett. <br /> (4) Display merchandise. Display of merchandise <br /> when in connection with a special occasion or merchant <br /> promotional activity, provided such exception shall not <br /> be granted by the City Council for a period in excess <br /> of fourteen (14) days. <br /> Section 5: That there is added to Chapter 13.12 a <br /> new section to read as follows, to-wit: <br /> 13. 12.040 Special conditions : <br /> The City Council in its discretion, in order to <br /> protect the public health, safety and welfare, may <br /> require a person placing a permitted object upon the <br /> sidewalk area to file with the City Clerk an indemnity <br /> agreement saving harmless the City of Everett from <br /> responsibility for injury or damage to any person or <br /> thing as a result of such object being placed upon the <br /> sidewalk area and may further require a bond conditioned <br /> that said individual so placing such permitted object <br /> upon the sidewalk area will indemnify the City from <br /> damages as a result of such object being placed on <br /> the said sidewalk area. <br /> Section 6: That there is added to Chapter 13. 12 a <br /> new section to read as follows, to-wit : <br /> 13. 12.050 Violations - penalty: <br /> Any person violating any of the provisions of <br /> this Chapter shall be deemed guilty of a misdemeanor <br /> and upon conviction thereof shall be fined an amount <br /> up to the sum of $100.00 or imprisoned in the City Jail <br /> for a time up to thirty (30) days, or both such fine <br /> and punishment may be imposed for violation of the <br /> provisions of this Chapter. <br /> Mayor <br /> Attest : <br /> 2/;‹, <br /> rCity Cler ~ / <br /> Passed: No v �, l f 6 `� <br /> Publ i shed: Nov 4 / l y <br />
