• <br /> 2. On-site is an animal shelter facility that is in an area proposed to be the location <br /> of the surcharge activity. The animal shelter facility, which is outside the <br /> shoreline jurisdiction boundary, will be demolished. (exhibit 1, staff report; <br /> Jimerson testimony) <br /> 3. The subject property is zoned Waterfront Commercial with a Planned <br /> Development Overlay. The site is being developed pursuant to a Development <br /> Agreement (RCW 36.70B.170). The Everett General Comprehensive Plan <br /> designation of the subject property is Waterfront Commercial. (exhibit 1, staff <br /> report; Jimerson testimony) <br /> 4. A portion of the subject property is within the shoreline jurisdiction of the <br /> Snohomish River, a significant shoreline within the State of Washington. <br /> Because the proposed project will exceed the threshold amount, a Shoreline <br /> Permit is required. See RCW Chapter 90.58. (exhibit 1, staff report; Jimerson <br /> testimony) <br /> 5. The subject property's shoreline designations are Urban Multi-Use and Urban <br /> Conservancy. The regrading of materials for the eventual development of the <br /> site is a permitted use in these designated areas. Portions of the subject <br /> property for the instant project that are within the shoreline jurisdiction but are not <br /> within a wetland buffer are designated as Urban Multi-Use. A purpose of an <br /> Urban Multi-Use designated area is to accommodate a multiplicity of urban uses <br /> such as water-oriented public and commercial activities, recreational and <br /> residential uses, and public access. The purposes of the Urban Conservancy <br /> designated area are to provide for public access and protection and the <br /> enhancement of ecological resources. Portions of the instant project that are <br /> within the shoreline jurisdiction and within a wetland buffer are designated as <br /> Urban Conservancy. Landfill and grading activities are allowed in an Urban <br /> Conservancy designated area. (exhibit 1, page 3, staff report; exhibit 13, page 3, <br /> power point; Jimerson testimony) <br /> 6. Pursuant to the State Environmental Policy Act (SEPA) (ROW 43.21 C), the City <br /> of Everett was designated as the lead agency for the determination of <br /> environmental impacts resulting from the project. The City adopted a Final <br /> Environmental Impact Statement (EIS) in June, 2008, and a subsequent <br /> addendum was issued in November, 2008. No appeals of the EIS or the <br /> addendum were submitted. (exhibit 1, staff report; exhibit 14, EIS; Jimerson <br /> testimony) <br /> 7. The proposed project will be developed on a 216 acre site. At complete build-out <br /> there will be approximately 1 .1 million square feet of commercial space along <br /> with 1 ,400 residential units. As part of the development, there will be significant <br /> and substantial public recreational amenities. With the entire development of <br /> commercial, residential, and recreational uses, certain amounts of wetlands will <br /> be preserved or restored.
