13. The City indicated that the proposed Shoreline Permit is the first permit for the <br /> Riverfront Redevelopment Project. (exhibit 1, staff report) The construction <br /> activity for future development of the site is not included as part of this project or <br /> permit. The permit that issought is strictly for the preparation of the site for <br /> future development. (exhibit 2, application; Jimerson testimony) <br /> 14. In preparing the staff report for the Shoreline Permit, the Everett Planning <br /> Department staff reviewed the City of Everett Shoreline Master Program <br /> regulations that have to be satisfied for any allowed uses in the Urban Multi-Use <br /> and Urban Conservancy designated areas. The applicable and relevant <br /> regulations were presented and addressed in the staff report. (exhibit 1, staff <br /> report; Jimerson testimony) <br /> 15. While the proposed project is not likely to uncover any significant archeological <br /> finds of interest, it will involve spreading and removing fill material over a landfill <br /> site. No native soils will be disturbed. In the remote possibility that archeological <br /> resources are discovered during the preparation process, the Applicant will be <br /> required to immediately stop work and notify the City of Everett and the Tulalip <br /> Tribes if anything of possible archeological interest is uncovered during <br /> excavation or development. (exhibit 1, staff report) <br /> 16. A portion of the site will be located in the Flood Fringe and Floodway Overlay <br /> zones. Those areas must comply with the provisions of the Everett Municipal <br /> Code (EMC) 19.30. All development that is to be located downriver from SR-529 <br /> must be done in a manner that is flood proofed in accordance with the <br /> requirements of EMC 19.30.040.C. (exhibit 1, staff report) <br /> 17. The subject property has portions that are within floodplains that have been <br /> identified as Zones X and AE on the Urban Flood Fringe District on the City's <br /> zoning map. Any development, including grading activity within these <br /> floodplains, is required to comply with the City's floodplain regulations as set forth <br /> in EMC 19.30. (exhibit 1, staff report) <br /> 18. Public access paths are a major component of the amenities that are to be <br /> derived from the redevelopment project. During the redevelopment construction <br /> phase of the project there will be access improvements installed by the <br /> developer. Access improvements will also be made by the City of Everett <br /> pursuant to the public amenities plan that is currently under consideration by the <br /> City. With these measures, the requirements for public access for the instant <br /> Shoreline Permit in these designated areas will be satisfied.
