13. The City indicated that the proposed Shoreline Permit is the first permit for the
Riverfront Redevelopment Project. (exhibit 1, staff report) The construction
activity for future development of the site is not included as part of this project or
permit. The permit that issought is strictly for the preparation of the site for
future development. (exhibit 2, application; Jimerson testimony)
14. In preparing the staff report for the Shoreline Permit, the Everett Planning
Department staff reviewed the City of Everett Shoreline Master Program
regulations that have to be satisfied for any allowed uses in the Urban Multi-Use
and Urban Conservancy designated areas. The applicable and relevant
regulations were presented and addressed in the staff report. (exhibit 1, staff
report; Jimerson testimony)
15. While the proposed project is not likely to uncover any significant archeological
finds of interest, it will involve spreading and removing fill material over a landfill
site. No native soils will be disturbed. In the remote possibility that archeological
resources are discovered during the preparation process, the Applicant will be
required to immediately stop work and notify the City of Everett and the Tulalip
Tribes if anything of possible archeological interest is uncovered during
excavation or development. (exhibit 1, staff report)
16. A portion of the site will be located in the Flood Fringe and Floodway Overlay
zones. Those areas must comply with the provisions of the Everett Municipal
Code (EMC) 19.30. All development that is to be located downriver from SR-529
must be done in a manner that is flood proofed in accordance with the
requirements of EMC 19.30.040.C. (exhibit 1, staff report)
17. The subject property has portions that are within floodplains that have been
identified as Zones X and AE on the Urban Flood Fringe District on the City's
zoning map. Any development, including grading activity within these
floodplains, is required to comply with the City's floodplain regulations as set forth
in EMC 19.30. (exhibit 1, staff report)
18. Public access paths are a major component of the amenities that are to be
derived from the redevelopment project. During the redevelopment construction
phase of the project there will be access improvements installed by the
developer. Access improvements will also be made by the City of Everett
pursuant to the public amenities plan that is currently under consideration by the
City. With these measures, the requirements for public access for the instant
Shoreline Permit in these designated areas will be satisfied. (exhibit 1, staff
report; Jimerson testimony)
r-
511
