I <br /> CITY OF EVERETT SPECIAL PROVISIONS [Modified per Addendum #1] <br /> 1-09.11A(5) Inefficiencies <br /> 1-09.11A(5)A Adjustment of Contract Sum <br /> To the extent Contractor is entitled to an increase in Contract Sum because of <br /> inefficiencies or impaired productivity, then compensation due shall be <br /> calculated as provided in 1-09.4 EQUITABLE ADJUSTMENT. <br /> 1-09.11A(5)B Adjustment of Contract Time <br /> To the extent Contractor is entitled to an extension of Contract Time because <br /> of inefficiencies or impaired productivity, then the extension shall be 111 <br /> determined as provided in 1-08.8 EXTENSIONS OF TIME. <br /> Supplement 1-09.11 by adding the followin g[Added per Addendum 1]: 1 <br /> 1-09.11(4) COVID-19 Contract Claims: Baseline COVID-19 Requirements <br /> Contractor shall in no event be entitled to assert a Contract Claim for increase to <br /> the Contract Sum for any direct or indirect costs (including without limitation <br /> Delay, cumulative impact, inefficiency or ripple costs) incurred by the Contractor <br /> to comply with the Baseline COVID-19 Requirements or any COVID-19 <br /> Requirements applicable to the Work after Bid opening that are equal to or less <br /> stringent than the Baseline COVID-19 Requirements. <br /> The Contractor shall be entitled to an extension of Contract Time for Delays to <br /> the extent caused by Baseline COVID-19 Requirements. Extension of Contract <br /> Time shall be determined pursuant to 1-08.8 EXTENSIONS OF TIME. This <br /> Contract Time extension is the Contractor's sole remedy if the Contract Time in111 <br /> the Contract Documents is insufficient to complete the Work because of <br /> Baseline COVID-19 Requirements. <br /> All other Contract Claims regarding COVID-19 are governed by Section 1- , <br /> 09.11A(3)D1 CAUSED SOLELY BY THIRD PARTIES OR FORCE MAJEURE. For <br /> example, Contract Claims governed by Section 1-09.11A(3)D1 include without <br /> limitation I <br /> • Contract Claims regarding COVID-19 Requirements applicable to the <br /> Work at any time after Bid opening that are more stringent than Baseline <br /> COVID-19 Requirements I <br /> • Contract Claims relating to unavailable or delayed labor, materials, <br /> equipment or subcontractors to the extent caused by COVID-19. <br /> Delete all of 1-09.12 and substitute the following: <br /> 1-09.12 Audits <br /> (******) <br /> 1-09.12(1) General <br /> The Contractor's records relating to this Project, including, but not limited to, wage, 1 <br /> payroll, and cost records, shall be open to inspection or audit by representatives of the <br /> City during the Project and for a period of not less than six years after the date of Final <br /> Acceptance of the Contract. The Contractor shall retain these records for that period. <br /> The Contractor shall also guarantee that Project records of Subcontractors, suppliers, <br /> and lower tier subcontractors, including, but not limited to, the wage, payroll, and cost <br /> records, shall be retained and open to similar inspection or audit for the same period of <br /> time. The audit may be performed by employees or representatives of the City or by <br /> Sewer 0 Division 1 —GENERAL REQUIREMENTS Addendum No. 1 <br /> WO No—UP3691 SP—134 May 2020 <br />
