These may include, but not be 20 limited to violent and dangerous individuals, hypodermic needles, garbage, broken 21 glass, human and animal excrement, drug paraphernalia, and other hazards. I 22 23 The Contractor shall take precautions and perform any necessary Work required to 24 provide and maintain a safe and healthful jobsite for all workers and the public for I 25 the duration of the project in accordance with all applicable laws and contract 26 requirements. 27 28 The Contractor shall ensure that the public, including persons who may be non- I29 English speaking or those who may not be able to recognize potential safety and 30 health hazards within the project area, are not harmed by the Contractors activities. 31 II 32 Nothing required by this Specification shall operate as a waiver of the Contractor's 33 responsibility for taking all steps necessary to ensure the safety of the public under 34 Section 1-07.23 or responsibility for liability and damages under Section 1-07.14 or I 35 for any other responsibility under the Contract or as may be required by law. 36 37 Health and Safety Plan I 38 The Contractor shall prepare a written Health and Safety Plan. The plan shall 39 be prepared under the supervision of a certified industrial hygienist and shall 40 incorporate all required County, State, and Federal health and safety provisions. I 41 The plan shall include requirements of the Federal Occupational Safety and 42 Health Act of 1970 (OSHA), all amendments, and all other applicable health 43 regulations. 44 I45 Preparation of the Health and Safety Plan shall include an initial site assessment 46 by the industrial hygienist. The plan shall break initial cleanup of the project into 47 identifiable construction areas. The plan shall be submitted to the Engineer prior II 48 to commencing cleanup Work. At least one copy of the plan shall be posted at 49 the work site while cleanup Work is in progress.
