I1 1-07.2(3) Services <br /> 2 <br /> I 3 The Contractor shall not collect retail sales tax from the Contracting Agency on any <br /> 4 contract wholly for professional or other services (as defined in Washington State <br /> 5 Department of Revenue Rules 138 and 244). <br /> I 6 <br /> 7 1-07.4.GR1 <br /> 8 Sanitation <br /> I 9 <br /> 10 1-07.4(2).GR1 <br /> 11 Health Hazards <br /> 1 12 <br /> 13 1-07.4(2).I NST1.G R 1 <br /> 14 Section 1-07.4(2) is revised to read: <br /> 15 <br /> 1 16 1-07.4(2).OPTI.FRI.DOCX <br /> 17 (August 7, 2017) <br /> 18 This project site is known to be occupied by transients and therefore contains <br /> I 19 biological hazards and associated physical hazards. These may include, but not be <br /> 20 limited to violent and dangerous individuals, hypodermic needles, garbage, broken <br /> 21 glass, human and animal excrement, drug paraphernalia, and other hazards. <br /> I 22 <br /> 23 The Contractor shall take precautions and perform any necessary Work required to <br /> 24 provide and maintain a safe and healthful jobsite for all workers and the public for <br /> I 25 the duration of the project in accordance with all applicable laws and contract <br /> 26 requirements. <br /> 27 <br /> 28 The Contractor shall ensure that the public, including persons who may be non- <br /> I29 English speaking or those who may not be able to recognize potential safety and <br /> 30 health hazards within the project area, are not harmed by the Contractors activities. <br /> 31 <br /> II 32 Nothing required by this Specification shall operate as a waiver of the Contractor's <br /> 33 responsibility for taking all steps necessary to ensure the safety of the public under <br /> 34 Section 1-07.23 or responsibility for liability and damages under Section 1-07.14 or <br /> I 35 for any other responsibility under the Contract or as may be required by law. <br /> 36 <br /> 37 Health and Safety Plan <br /> I 38 The Contractor shall prepare a written Health and Safety Plan. The plan shall <br /> 39 be prepared under the supervision of a certified industrial hygienist and shall <br /> 40 incorporate all required County, State, and Federal health and safety provisions. <br /> I 41 The plan shall include requirements of the Federal Occupational Safety and <br /> 42 Health Act of 1970 (OSHA), all amendments, and all other applicable health <br /> 43 regulations. <br /> 44 <br /> I45 Preparation of the Health and Safety Plan shall include an initial site assessment <br /> 46 by the industrial hygienist. The plan shall break initial cleanup of the project into <br /> 47 identifiable construction areas. The plan shall be submitted to the Engineer prior <br /> II 48 to commencing cleanup Work. At least one copy of the plan shall be posted at <br /> 49 the work site while cleanup Work is in progress.
