I1 2 Force Account Work—Work measured and paid in accordance with Section 1- I 3 09.6. 4 5 Good Faith Efforts — Efforts to achieve the UDBE COA Goal or other I 6 requirements of this part which, by their scope, intensity, and appropriateness to 7 the objective, can reasonably be expected to fulfill the program requirement. 8 I 9 Manufacturer (DBE) — A DBE firm that operates or maintains a factory or 10 establishment that produces on the premises the materials, supplies, articles, or 11 equipment required under the Contract. A DBE Manufacturer shall produce I12 finished goods or products from raw or unfinished material or purchase and 13 substantially alters goods and materials to make them suitable for construction 14 use before reselling them. 15 I 16 Reasonable Fee (DBE) — For purposes of Brokers or service providers a 17 reasonable fee shall not exceed 5% of the total cost of the goods or services 18 brokered. I 19 20 Regular Dealer (DBE) —A DBE firm that owns, operates, or maintains a store, 21 warehouse, or other establishment in which the materials or supplies required I 22 23 for the performance of a Contract are bought, kept in stock, and regularly sold to the public in the usual course of business. To be a Regular Dealer, the DBE 24 firm must be an established regular business that engages in as its principal I25 business and in its own name the purchase and sale of the products in question. 26 A Regular Dealer in such items as steel, cement, gravel, stone, and petroleum 27 products need not own, operate or maintain a place of business if it both owns 28 and operates distribution equipment for the products. Any supplementing of I 29 regular dealers' own distribution equipment shall be by long-term formal lease 30 agreements and not on an ad-hoc basis. Brokers, packagers, manufacturers' 31 representatives, or other persons who arrange or expedite transactions shall not I 32 be regarded as Regular Dealers within the meaning of this definition. 33 34 Underutilized Disadvantaged Business Enterprise (UDBE) — A DBE Firm I 35 that is underutilized based on WSDOT's Disparity Study. 36 37 UDBE Commitment — The dollar amount the Bidder indicates they will be I 38 39 subcontracting to be applied towards the UDBE Condition of Award Goal as shown on the UDBE Utilization Certification Form for each UDBE Subcontractor. 40 This UDBE Commitment amount will be incorporated into the Contract and shall I41 be considered a Contract requirement. Any changes to the UDBE Commitment 42 require the Engineer's approval. 43 44 UDBE Condition of Award (COA) Goal — An assigned numerical amount 111 45 specified as a percentage of the Contract. Initially, this is the minimum amount 46 that the Bidder must commit to by submission of the Utilization Certification Form 47 and/or by Good Faith Effort (GFE).
