I1 <br /> 2 Force Account Work—Work measured and paid in accordance with Section 1- <br /> I 3 09.6. <br /> 4 <br /> 5 Good Faith Efforts — Efforts to achieve the UDBE COA Goal or other <br /> I 6 requirements of this part which, by their scope, intensity, and appropriateness to <br /> 7 the objective, can reasonably be expected to fulfill the program requirement. <br /> 8 <br /> I <br /> 9 Manufacturer (DBE) — A DBE firm that operates or maintains a factory or <br /> 10 establishment that produces on the premises the materials, supplies, articles, or <br /> 11 equipment required under the Contract. A DBE Manufacturer shall produce <br /> I12 finished goods or products from raw or unfinished material or purchase and <br /> 13 substantially alters goods and materials to make them suitable for construction <br /> 14 use before reselling them. <br /> 15 <br /> I <br /> 16 Reasonable Fee (DBE) — For purposes of Brokers or service providers a <br /> 17 reasonable fee shall not exceed 5% of the total cost of the goods or services <br /> 18 brokered. <br /> I 19 <br /> 20 Regular Dealer (DBE) —A DBE firm that owns, operates, or maintains a store, <br /> 21 warehouse, or other establishment in which the materials or supplies required <br /> I <br /> 22 23 for the performance of a Contract are bought, kept in stock, and regularly sold <br /> to the public in the usual course of business. To be a Regular Dealer, the DBE <br /> 24 firm must be an established regular business that engages in as its principal <br /> I25 business and in its own name the purchase and sale of the products in question. <br /> 26 A Regular Dealer in such items as steel, cement, gravel, stone, and petroleum <br /> 27 products need not own, operate or maintain a place of business if it both owns <br /> 28 and operates distribution equipment for the products. Any supplementing of <br /> I <br /> 29 regular dealers' own distribution equipment shall be by long-term formal lease <br /> 30 agreements and not on an ad-hoc basis. Brokers, packagers, manufacturers' <br /> 31 representatives, or other persons who arrange or expedite transactions shall not <br /> I <br /> 32 be regarded as Regular Dealers within the meaning of this definition. <br /> 33 <br /> 34 Underutilized Disadvantaged Business Enterprise (UDBE) — A DBE Firm <br /> I <br /> 35 that is underutilized based on WSDOT's Disparity Study. <br /> 36 <br /> 37 UDBE Commitment — The dollar amount the Bidder indicates they will be <br /> I <br /> 38 39 subcontracting to be applied towards the UDBE Condition of Award Goal as <br /> shown on the UDBE Utilization Certification Form for each UDBE Subcontractor. <br /> 40 This UDBE Commitment amount will be incorporated into the Contract and shall <br /> I41 be considered a Contract requirement. Any changes to the UDBE Commitment <br /> 42 require the Engineer's approval. <br /> 43 <br /> 44 UDBE Condition of Award (COA) Goal — An assigned numerical amount <br /> 111 45 specified as a percentage of the Contract.
