1 1 <br /> 2 The Board members shall: <br /> 3 I 4 1. Be experienced in the interpretation of construction contract <br /> 5 documents. <br /> 6 I 7 2. Have attended training by the Dispute Resolution Board Foundation in <br /> 8 dispute resolution within the last five years. <br /> 9 I 10 3. Be experienced in construction Contract dispute resolution for an <br /> 11 owner or Contractor at the level of having responsibility and authority <br /> 12 to settle disputes. <br /> 13 <br /> 14 4. Be able to discharge their responsibilities impartially and <br /> 15 independently, considering the facts and conditions related to the <br /> 16 matters under consideration in strict compliance with the provisions of I <br /> 17 the Contract. <br /> 18 <br /> 19 5. Not be a current employee of any party directly or indirectly involved. <br /> 20 <br /> 21 6. Not have been an employee of any party directly or indirectly involved <br /> 22 with the Project within a period of one year of the Contract Execution <br /> 23 date. <br /> 24 <br /> 25 7. Not have a financial interest in the Contract except for payments for <br /> 26 services on the Board. <br /> 27 <br /> 28 Board Member Ongoing Responsibilities <br /> 29 While serving on the Disputes Review Board on this project: <br /> 30 <br /> 31 1. Board members shall not participate in any discussion contemplating <br /> 32 the creation of an agreement or making an agreement with any party I <br /> 33 directly or indirectly involved in the Contract regarding employment or <br /> 34 fee-based consulting services, or any other business arrangement after <br /> 35 the Contract is completed. <br /> 36 <br /> 37 2. Board members shall not officially give any advice to either party. The <br /> 38 individual members will act in a completely independent manner and <br /> 39 will have no consulting or business connections with either party, <br /> 40 except for payments for services on the Board. <br /> 41 <br /> 42 3. During routine meetings of the Board as well as during formal hearings, III <br /> 43 Board members shall refrain from expressing opinions on the merits of <br /> 44 statements on matters under dispute or potential dispute. Opinions of <br /> 45 Board members expressed in private sessions with other Board <br /> 46 members should be kept strictly confidential. <br /> 47 <br /> 48 4. The Board shall comply with the terms of the Contract and enforce such I <br /> 49 terms consistent with the laws of the State of Washington. Board <br /> 50 members shall not supplant or otherwise interfere with the respective <br /> 51 rights, authorities, duties and obligations of the parties as defined in the I <br /> 52 Contract.
