I1 iii. The expert's name and a general statement of the area of 2 expertise they will provide. I 3 4 iv. A statement prepared by the proposed expert which 5 addresses the requirements of the Establishment of the I 6 Board subsection of this Special Provision, item 2. 7 8 v. A statement prepared by the proposed expert which identifies I9 10 the experience and training which qualifies them as an expert. 11 vi. A confidentiality statement, consistent with the confidentiality 12 obligations of the Board described in the Three Party I13 Agreement, executed by the proposed expert. 14 15 Disputes Review Board Report 16 The Board's recommendations shall be formalized in a written report signed 17 by all Board members. The recommendations shall be based on the 18 Contract Provisions and the facts and circumstances involved in the I 19 20 dispute. The report should include a description of the dispute, statements of each party's position, findings as to the facts of the dispute, discussion 21 and rationale for the recommendation(s), and the recommendation(s). The 22 report shall be submitted concurrently to the parties, as soon as possible 23 after completion of the hearing as agreed by all parties. 24 I 25 Either party may request clarification of a report within 14 calendar days 26 following receipt of the report. Within a reasonable period of time, the Board 27 shall provide written clarification to both parties. Requests for clarification 28 shall be submitted in writing simultaneously to the Board and the other party. I29 30 Either party may request reconsideration of a report, provided: 31 I 32 1. The request is made within 14 calendar days following receipt of 33 the report, and 34 I 35 2. New information is obtained or developed that was not known at 36 the time of the hearing or, in the party's opinion, the Board 37 misunderstood or failed to consider pertinent facts of the dispute. I 38 39 Requests for reconsideration shall be submitted in writing simultaneously to 40 the Board and the other party. The Board shall give the party not requesting I 41 reconsideration the option of submitting a rebuttal to any information that is 42 the basis of the request for reconsideration. The Board shall provide a 43 written response to the request for reconsideration. 44 45 Acceptance of Disputes Review Board Recommendations 46 Within 30 calendar days of receiving the Board's report, or within 14 47 calendar days of receiving the Board's written clarification and/or I 48 reconsideration, both the Contracting Agency and the Contractor shall 49 respond to the other in writing signifying that the dispute is either resolved 50 or remains unresolved.
