I1 iii. The expert's name and a general statement of the area of <br /> 2 expertise they will provide. <br /> I 3 <br /> 4 iv. A statement prepared by the proposed expert which <br /> 5 addresses the requirements of the Establishment of the <br /> I 6 Board subsection of this Special Provision, item 2. <br /> 7 <br /> 8 v. A statement prepared by the proposed expert which identifies <br /> I9 10 the experience and training which qualifies them as an expert. <br /> 11 vi. A confidentiality statement, consistent with the confidentiality <br /> 12 obligations of the Board described in the Three Party <br /> I13 Agreement, executed by the proposed expert. <br /> 14 <br /> 15 Disputes Review Board Report <br /> 16 The Board's recommendations shall be formalized in a written report signed <br /> 17 by all Board members. The recommendations shall be based on the <br /> 18 Contract Provisions and the facts and circumstances involved in the <br /> I 19 20 dispute. The report should include a description of the dispute, statements <br /> of each party's position, findings as to the facts of the dispute, discussion <br /> 21 and rationale for the recommendation(s), and the recommendation(s). The <br /> 22 report shall be submitted concurrently to the parties, as soon as possible <br /> 23 after completion of the hearing as agreed by all parties. <br /> 24 <br /> I 25 Either party may request clarification of a report within 14 calendar days <br /> 26 following receipt of the report. Within a reasonable period of time, the Board <br /> 27 shall provide written clarification to both parties. Requests for clarification <br /> 28 shall be submitted in writing simultaneously to the Board and the other party. <br /> I29 <br /> 30 Either party may request reconsideration of a report, provided: <br /> 31 <br /> I 32 1. The request is made within 14 calendar days following receipt of <br /> 33 the report, and <br /> 34 <br /> I 35 2. New information is obtained or developed that was not known at <br /> 36 the time of the hearing or, in the party's opinion, the Board <br /> 37 misunderstood or failed to consider pertinent facts of the dispute. <br /> I 38 <br /> 39 Requests for reconsideration shall be submitted in writing simultaneously to <br /> 40 the Board and the other party. The Board shall give the party not requesting <br /> I 41 reconsideration the option of submitting a rebuttal to any information that is <br /> 42 the basis of the request for reconsideration. The Board shall provide a <br /> 43 written response to the request for reconsideration. <br /> 44 <br /> 45 Acceptance of Disputes Review Board Recommendations <br /> 46 Within 30 calendar days of receiving the Board's report, or within 14 <br /> 47 calendar days of receiving the Board's written clarification and/or <br /> I 48 reconsideration, both the Contracting Agency and the Contractor shall <br /> 49 respond to the other in writing signifying that the dispute is either resolved <br /> 50 or remains unresolved.
