(However, bidders that have completed three or <br /> more public works projects and maintained a valid business license <br /> in Washington for at least three years are exempt from this <br /> requirement.) <br /> 7) Supplemental Bidder Responsibility Criteria: RCW 39.04.350(2). If <br /> this Project is subject to supplemental bidder responsibility criteria, <br /> then such criteria will be contained in SECTION 002213, <br /> SUPPLEMENTAL INSTRUCTIONS TO BIDDERS. If there is no <br /> SECTION 002213, SUPPLEMENTAL INSTRUCTIONS TO BIDDERS in the <br /> bid package, then the Project is not subject to supplemental bidder <br /> responsibility criteria. <br /> d. BID PROTESTS: All protests by Bidders must be in accordance with <br /> Everett Municipal Code 3.46, "Bid Protest Procedures." <br /> B. Pre-Award Conference <br /> 1. After Bid opening, but prior to award, the apparent successful Bidder shall, if <br /> requested by the City, attend a pre-award conference to respond to questions by <br /> the City regarding evaluation of Bids. The City will emphasize items such as <br /> insurance and bonding that will assist in prompt issuance of the Notice to <br /> proceed. By conducting a pre-award conference, the City has not thereby <br /> waived its right to make determinations regarding responsiveness and <br /> responsibility of the Bidder. <br /> C. Acceptance of Bid <br /> 1. Within 60 days after the opening of Bids, the City will act either to accept the Bid <br /> from the lowest responsive, responsible Bidder, or to reject all Bids. The City <br /> reserves the right to request extensions of such Bid acceptance period. The <br /> acceptance of a Bid will be evidenced by a written Notice of Award of Contract <br /> delivered in person or by certified mail to the Bidder whose Bid is accepted, <br /> together with a request to furnish a performance and payment bond and <br /> evidence of insurance and to execute the Contract set forth in the Contract <br /> Documents. <br /> 2. Bidder has 14 calendar days after receiving the Notice of Award to submit the <br /> following documents to the City: <br /> a. Two (2) executed copies of the Contract. <br /> b. Contract bond or equivalent performance and payment bond per SECTION <br /> 007200, Part 15.2 "Bonds", of the Contract Documents. <br /> c. Certificate of Insurance and additional insured endorsement, SECTION <br /> 007200, Part 15.3 "Insurance", of the Contract Documents. <br /> 3. A Contract shall not be formed until the Contract Documents are signed by the <br /> Mayor. <br /> 1.14 TIME OF COMPLETION <br /> A.
