I T <br /> • <br /> ` ` I ti <br /> 1 <br /> '2 ORDINANCE NO. 3941. <br /> 3 AN ORDINANCE amending Chapter 2.24 of the Everett City Code, <br /> being Ordinance No. 3115, as amended, providing for the inspection, <br /> 4 regulation and control of dangerous buildings within the City of Everett, <br /> the repair and maintenance of dangerous buildings, the occupancy of <br /> 5 dangerous buildings, the removal of said dangerous buildings, declaring <br /> and defining dangerous buildings as public nuisances, providing for <br /> 6 notices and orders of demolition and penalties, and for the assessment <br /> of the cost of vacation, removal, repair or demolition thereof as a <br /> 7 municipal lien or assessment against such premises and or provide for the <br /> recovery of such costs in an action at law, and repealing section 203 of <br /> 8 the 1961 Edition of the Uniform Building Code as adopted and codified <br /> under Chapter 2.12 of the Everett City Code. <br /> 9 <br /> NOW. THEREFORE, THE CITY OF EVE'ETT DOES ORDAIN: <br /> 10 SECTION 1: That Section 2.24.010, Everett City Code, is <br /> amended to read as follows: <br /> 11 <br /> 2.24.101 Dangerous Buildings Defined and Declared to be Public <br /> 12 Nuisances. All buildings or structures which have any or all <br /> of the following defects shall be deemed "dangerous buildings": <br /> 13 <br /> (a) Those whose interior walls or other vertical structural <br /> 14 members list, lean or buckle to such an extent that a plumb <br /> line passing through the center of gravity falls outside of <br /> 15 the middle third of its base. <br /> 16 (b) Those which, exclusive of the foundation, show thirty- <br /> three percent (33%) or more, of damage or deterioration of <br /> 17 the supporting member or members, or fifty percent (50%) of <br /> damage or deterioration of the non-supporting enclosing or <br /> 18 outside walls or covering. <br /> 19 (c) Those which have improperly distributed loads upon the <br /> floors or roofs or in which the same are overloaded, or which <br /> 20 have insufficient strength to be reasonably safe for the <br /> purpose used. <br /> 21 <br /> (d) Those which have been damaged by fire, wind or other <br /> 22 causes so as to have become dangerous to life, safety, <br /> morals, or the general health and welfare of the occupants <br /> 23 or the people of the City of Everett. <br /> 24 (e) Those which have become or are so dilapidated, decayed, <br /> unsafe, insanitary or which so utterly fail to provide the <br /> 25 amenities essential to decent living that they are unfit for <br /> human habitation, or are likely to cause sickness or disease, <br /> 26 so as to work injury to the health, morals, safety or <br /> general welfare of human beings who live or may live therein. <br /> 27 and/or heating <br /> (f) Those having light, air and sanitation facilities which <br /> 28 are inadequate to protect the health, morals, safety or <br /> general welfare of human beings who live or may live therein. <br /> 29 <br /> 30 <br /> 31 <br /> -1- <br /> 32 <br />
