I T • ` ` I ti 1 '2 ORDINANCE NO. 3941. 3 AN ORDINANCE amending Chapter 2.24 of the Everett City Code, being Ordinance No. 3115, as amended, providing for the inspection, 4 regulation and control of dangerous buildings within the City of Everett, the repair and maintenance of dangerous buildings, the occupancy of 5 dangerous buildings, the removal of said dangerous buildings, declaring and defining dangerous buildings as public nuisances, providing for 6 notices and orders of demolition and penalties, and for the assessment of the cost of vacation, removal, repair or demolition thereof as a 7 municipal lien or assessment against such premises and or provide for the recovery of such costs in an action at law, and repealing section 203 of 8 the 1961 Edition of the Uniform Building Code as adopted and codified under Chapter 2.12 of the Everett City Code. 9 NOW. THEREFORE, THE CITY OF EVE'ETT DOES ORDAIN: 10 SECTION 1: That Section 2.24.010, Everett City Code, is amended to read as follows: 11 2.24.101 Dangerous Buildings Defined and Declared to be Public 12 Nuisances. All buildings or structures which have any or all of the following defects shall be deemed "dangerous buildings": 13 (a) Those whose interior walls or other vertical structural 14 members list, lean or buckle to such an extent that a plumb line passing through the center of gravity falls outside of 15 the middle third of its base. 16 (b) Those which, exclusive of the foundation, show thirty- three percent (33%) or more, of damage or deterioration of 17 the supporting member or members, or fifty percent (50%) of damage or deterioration of the non-supporting enclosing or 18 outside walls or covering. 19 (c) Those which have improperly distributed loads upon the floors or roofs or in which the same are overloaded, or which 20 have insufficient strength to be reasonably safe for the purpose used. 21 (d) Those which have been damaged by fire, wind or other 22 causes so as to have become dangerous to life, safety, morals, or the general health and welfare of the occupants 23 or the people of the City of Everett. 24 (e) Those which have become or are so dilapidated, decayed, unsafe, insanitary or which so utterly fail to provide the 25 amenities essential to decent living that they are unfit for human habitation, or are likely to cause sickness or disease, 26 so as to work injury to the health, morals, safety or general welfare of human beings who live or may live therein. 27 and/or heating (f) Those having light, air and sanitation facilities which 28 are inadequate to protect the health, morals, safety or general welfare of human beings who live or may live therein. 29 30 31 -1- 32
