I 4 { • 1 SECTION 7: That Section 2.24.060, Everett City Code, is hereby amended to read as follows: 2 2t24.060. Owner or Other Parties in Interest Given Right to Appeal. 3 (a) The owner or any party in interest as defined or disclosed 4 by the records of the Snohomish County Auditor may, within thirty (30) days of the date of service upon the owner and 5 posting of an Order issued by the Board or by the Inspector or officer under the provisions of this Ordinance, file an appeal 6 with the Appeals Commission. 7 (b) There is hereby established and created an Appeals Commission to act as a review board, to review the orders of 8 the Inspectors of the City or other officers of the City, or the Improvement Board, which Appeals Commission shall be composed 9 of the Building Inspector as Secretary, and ex officio member and three residents of the City of Everett appointed by the 10 Commissioner of Public Works. 11 (c) Duties of the City Building Inspector. It shall be the duty of the City Building Inspector as the secretary of the 12 Appeals Board to have on hand and keep in his office forms for appeal from such unfit building orders. Said City Building Inspector 13 shall keep the record of all such appeals, shall have authority to schedule hearings or dates for review of such unfit building 14 orders before the Appeals Board and shall keep the records of such Appeals Boards, its sessions, the dates thereof, the names of 15 the members present, the witnesses heard giving testimony in each particular case. 16 (d) Any owner or party in interest as disclosed by the reocords 17 of the 6nohomish bounty Auditor affected by the issuance of such unfit building order who desires to appeal such order for 18 review before the hppeals Board or Commission, may do so by complying with the following steps, which steps shall be 19 considered jurisdictional, as follows, to-wit: 20 1. File two (2) copies of Notice of Appeal with the Building Inspector of the City of Everett as Secretary 21 of.the Appeale',Comraission. rit in thirty (30) days after date of service of the unfit building order 22 upon the owner and posting of the order issued by the Board or officer upon the premises; 23 2. Post the sum of Twenty-five and no/100 ( N25.00) 24 Dollars with the said Building Inspector to cover the cost of appeal. 25 (e) In the event the owner or other party in interest as 26 defined in this Ordinance, seeking a review, before the Appeals Commission, fails to comply with the steps herein 27 set forth, then the Building Inspector or the City Attorney for the City of Everett may dismiss such appeal upon motion to 28 said Appeals Commission or Board, which shall grant such motion if the appellant has not complied with the jurisdictional 29 steps hereinabove set forth. 30 31 32 -6-
