I 4 <br /> { • <br /> 1 SECTION 7: That Section 2.24.060, Everett City Code, is hereby <br /> amended to read as follows: <br /> 2 <br /> 2t24.060. Owner or Other Parties in Interest Given Right to Appeal. <br /> 3 <br /> (a) The owner or any party in interest as defined or disclosed <br /> 4 by the records of the Snohomish County Auditor may, within <br /> thirty (30) days of the date of service upon the owner and <br /> 5 posting of an Order issued by the Board or by the Inspector or <br /> officer under the provisions of this Ordinance, file an appeal <br /> 6 with the Appeals Commission. <br /> 7 (b) There is hereby established and created an Appeals <br /> Commission to act as a review board, to review the orders of <br /> 8 the Inspectors of the City or other officers of the City, or <br /> the Improvement Board, which Appeals Commission shall be composed <br /> 9 of the Building Inspector as Secretary, and ex officio member <br /> and three residents of the City of Everett appointed by the <br /> 10 Commissioner of Public Works. <br /> 11 (c) Duties of the City Building Inspector. It shall be the <br /> duty of the City Building Inspector as the secretary of the <br /> 12 Appeals Board to have on hand and keep in his office forms for appeal <br /> from such unfit building orders. Said City Building Inspector <br /> 13 shall keep the record of all such appeals, shall have authority <br /> to schedule hearings or dates for review of such unfit building <br /> 14 orders before the Appeals Board and shall keep the records of <br /> such Appeals Boards, its sessions, the dates thereof, the names of <br /> 15 the members present, the witnesses heard giving testimony in <br /> each particular case. <br /> 16 <br /> (d) Any owner or party in interest as disclosed by the reocords <br /> 17 of the 6nohomish bounty Auditor affected by the issuance of <br /> such unfit building order who desires to appeal such order for <br /> 18 review before the hppeals Board or Commission, may do so by <br /> complying with the following steps, which steps shall be <br /> 19 considered jurisdictional, as follows, to-wit: <br /> 20 1. File two (2) copies of Notice of Appeal with the <br /> Building Inspector of the City of Everett as Secretary <br /> 21 of.the Appeale',Comraission. rit in thirty (30) days <br /> after date of service of the unfit building order <br /> 22 upon the owner and posting of the order issued by the <br /> Board or officer upon the premises; <br /> 23 <br /> 2. Post the sum of Twenty-five and no/100 ( N25.00) <br /> 24 Dollars with the said Building Inspector to cover the <br /> cost of appeal. <br /> 25 <br /> (e) In the event the owner or other party in interest as <br /> 26 defined in this Ordinance, seeking a review, before the <br /> Appeals Commission, fails to comply with the steps herein <br /> 27 set forth, then the Building Inspector or the City Attorney for <br /> the City of Everett may dismiss such appeal upon motion to <br /> 28 said Appeals Commission or Board, which shall grant such <br /> motion if the appellant has not complied with the jurisdictional <br /> 29 steps hereinabove set forth. <br /> 30 <br /> 31 <br /> 32 -6- <br />
