a I <br /> 1 appear at all hearings conducted by the Improvement Board and <br /> Appeals Commission and to further appear at all hearings in the <br /> 2 municipal court or higher court at the instance and direction <br /> of the City Attorney to testify as to the Condition of "dangerous <br /> 3 buildings". <br /> 4 SECTION 4: That Section 2.24.030 of the Everett. City Code is <br /> hereby amended to read as follows: <br /> 5 <br /> 2.24.040. Notice and Complaint -- How Served.. The Complaint of the <br /> 6 Officer or Inspector or Board shall be served either personally or <br /> by registered mail upon all persons having any interest in the <br /> 7 subject property upon which the alleged building is situated as shown <br /> upon the records of the Snohomish County Auditor and a copy of such Com- <br /> 8 plaint, together with Notice, shall be posted in a conspicuous place <br /> on such property. If the whereabouts of such person or persons in <br /> 9 interest in the property as disclosed as herein provided is unknown <br /> and the same cannot be ascertained by the officer or Board in the <br /> 10 exercise of reasonable diligence and the Board or officer shall make <br /> an affidavit to that effect, then the serving of such Complaint and <br /> 11 Notice or Order upon such person or persons may be made by publishing <br /> tie same once each week for two (2) consecutive weeks in a newspaper <br /> 12 published in the City of Everett, and in the event of inability to <br /> publish, such Notice and Complaint shall be posted in three (3) <br /> 13 public places in the municipality of the City of Everett. Such <br /> Complaint and Notice shall contain a notice that a hearing will be <br /> 14 held before the Improvement Board or officer, as the case may be, at a <br /> place therein fixed not less than ten (10) days nor more than <br /> 15 thirty (30) days after the serving of said Complaint; a copy of said <br /> Complaint shall be filed with the Snohomish County Auditor as here- <br /> 16 inabove provided. <br /> 17 SECTION 5: That Section 2.24.040, Everett City Code is hereby <br /> amended to read as follows: <br /> 18 2.4.040. Notice Posted on Building Not to be Removed until Matter <br /> 19 Di$posed of: The Complaint and Notice posted upon the dwelling, <br /> building or structure by the Board or officer of the City shall not <br /> 20 be removed until a determination of the building's fitness shall be <br /> made as provided in this Ordinance, and if the order is that said <br /> 21 building be repaired, improved or demolished, said notice shall not <br /> be removed until such order has been carried out or the order <br /> 22 reversed by the appeals commission or order of the Superior Court <br /> of the State of Washington for Snohomish County, or other Higher Court. <br /> 23 Anyone removing said Complaint and Notice and/or order issued upon <br /> such Complaint shall be guilty of a misdemeanor and subject to fine and <br /> 24 imprisonment as hereinafter set forth. <br /> 25 SECTION 6: That Section 2.24.050, Everett City Code, is hereby <br /> amended to read as follows: <br /> 26 2,24.050. Unlawful to Occupy. It shall be unlawful for any occupant <br /> 27 to remain in or reside in any building which has been properly <br /> posted with notice as provided in Section 2.24.040 of this Chapter <br /> 23 until such time as said notice has Leen removed by the order of the <br /> Building Inspector of said City. <br /> 29 <br /> 30 <br /> 31 <br /> 32 -5- <br />
