r >� <br /> 1 such building, dwelling or structure to be repaired, altered, improved, <br /> vacated, closed, removed or demolished, the amount of the cost of such <br /> 2 repairs, alterations of improvements, or vacating and closing, or <br /> removal or demolition, shall be assessed against the real property <br /> 3 upon which such cost was incurred, unless such amount is previously <br /> paid. The Building Inspector shall certify to the City Treasurer the <br /> 4 amount so incurred and due and owing, and the City Treasurer shall <br /> certify to the County Treasurer of the County of Snohomish the total <br /> 5 amount of the assessment so received from the Building Inspector in <br /> the manner provided by .9. C. W. 35.80.030 (1) (h), and any amount so <br /> 6 received from the County Treasurer shall be deposited to the credit <br /> of the general fund of the City of Everett; provided, that if the total <br /> 7 assessment due and owing exceeds Twstn4-five Dollars ($25.00), the <br /> City Council shall , upon written request of the owner or party in interest, <br /> 8 divide the amount due into ten (10) equal annual installments, subject <br /> to earlier payment at the option of the owner or party in interest. <br /> 9 Provided further, if the dwelling, building or structure is removed or <br /> demolished by City officers or the Improvement Board's order, said <br /> 10 Board or officer shall, if possible, sell the materials of such <br /> dwelling, building or structure, after a call for bids, to the highest <br /> 11 bidder, and shall credit the proceeds of such sale against the cost <br /> of the removal or demolition, and if there be any balance remaining <br /> 12 it shall be paid to the parties entitled thereto as determined by <br /> the Improvement Board or Inspector or Officer, after deducting the <br /> 13 cost incident thereto. <br /> 14 SECTION 11: That there is added to Chapter 2.24 a section as <br /> follows: <br /> 15 <br /> 2.24.091. Emeeency Cases. In cases where it reasonably appears that ther <br /> 16 is immediate danger to the life or safety of any person unless a "dan- <br /> gerous building" as defined is immediately repaired, vacated, or <br /> 17 demolished, the Building Inspector shall report such facts to the City <br /> Council and the City Council shall cause a resolution to be passed <br /> 18 authorizing the Building Inspector to effect the immediate repair, <br /> vacation or demolition of such "dangerous building". The costs of <br /> 19 such emergency repair, vacation or demolition of such "dangerous <br /> building" shall be collected in the same manner as provided in Section <br /> 20 2.24.090 hereof. <br /> 21 SECTION 12: That there is added to Chapter 2.24, Everett City <br /> Code, a new Section to read as follows: <br /> 22 <br /> 2.24.092. Administrative Liability. No officer, agent, or employee <br /> 23 of the City of Everett shall render himself personally liable for any <br /> damage that may accrue to persons or property as a result of any act <br /> 24 required or permitted in the discharge of his duties under this <br /> Ordinance. Any suit brought against any officer, agent, or employee <br /> 25 of the City of Everett as a result of any act required or permitted in <br /> the discharge of his duties under this Ordinance shall be defended by <br /> 26 the City Attorney until the final determination of the proceedings <br /> therein. <br /> 27 <br /> SECTION 13: That there is added to Chapter 2.24, Everett City <br /> 28 Code, a new section to read as follows: <br /> 29 2.24.093. Duties of Fire Department. The employees of the Fire <br /> Department shall make a report in writing to the Building Inspector <br /> 30 of all buildings or structures which are, may be, or are, suspected to <br /> be "dangerous buildings" within the terms of this Ordinance.
