ORDINANCE NO. 3013-07 <br /> An Ordinance Amending Ordinance No. 1671-89, <br /> As Amended, Rezoning Property Located At 216 <br /> Mukilteo Boulevard From Single Family (R-1) <br /> To Community Business (B-2), Subject To <br /> Conditions Of A Development Agreement <br /> WHEREAS, the City of Everett adopted a Comprehensive Plan in August, 1994, in <br /> conformance with the Washington State Growth Management Act; and <br /> WHEREAS, the City of Everett adopted the 10 year update to the Comprehensive Plan, in <br /> conformance with the Washing Growth Management Act on July 20, 2005; and <br /> WHEREAS, the Growth Management Act, codified as Chapter 36.70A, allows for <br /> comprehensive plans to be amended on an annual basis; and <br /> WHEREAS, the City of Everett initiated its 2006 annual comprehensive plan amendment <br /> process in July, 2006, which included consideration of Land Use Map amendments and rezone <br /> applications initiated by property owners; and <br /> WHEREAS, Our Savior's Lutheran Church submitted an application to rezone from R-1 to B-2 <br /> (Exhibit A) for a site located at 215 Mukilteo Boulevard; and <br /> WHEREAS, the Planning Commission held a workshop to review the application on February <br /> 20, 2007 and a decision public hearing was held of May 15, 2007, at which time they considered <br /> public testimony and heard applicant and staff presentations and considered the various aspects <br /> of the proposal; and <br /> WHEREAS, at the public hearing on May 15, 2007, the Church representative, Reid Shockey, <br /> stated the reason for the requested B-2 zone is so the Church can be allowed to install an <br /> electronic, illuminated, changing message sign, with no other reason given for the requested <br /> rezone. Mr. Shockey then stated the Church is willing to enter into a contractual relationship <br /> with the City committing that the property would be used for church purposes only, and further <br /> that the Church would agree to certain restrictions on how the electronic, changing message sign <br /> would be operated so as to eliminate any impacts from its use; and <br /> - 1 - <br />
