WHEREAS, Following the May 15, 2007 public hearing, and taking into consideration public <br /> input, the Planning Commission did resolve to recommend to City Council that the rezone be <br /> approved, subject to conditions of a development agreement; and <br /> WHEREAS, THE EVERETT CITY COUNCIL FINDS: <br /> 1. The sole purpose for the requested rezone is to allow Our Savior's Lutheran Church to <br /> install, in a legally existing permanent sign, an electronic, illuminated, changing message <br /> sign component, which the requested B-2 zone will allow; and <br /> 2. To achieve the proposed sign use, and to limit other uses identified with the B-2 zone, and to <br /> limit potential impacts from the proposed electronic, illuminated changing message sign, the <br /> City needs to rezone the Church property from R-1 (Single Family) to B-2 (Community <br /> Business); and. <br /> 3. The public health, safety and welfare would be provided for by the proposal only if the <br /> amendment and rezone were implemented by a Development Agreement that the Mayor is <br /> authorized by City Council to sign, along with authorized representative(s) of the Church; <br /> and <br /> 4. The proposed rezone promotes the best long term interest of the Everett Community only if <br /> the proposal is supported through use of a development agreement that will ensure the <br /> conditions specified herein will be met, with penalties provided if they are not; and <br /> WHEREAS CITY COUNCIL CONCLUDES: <br /> 1. The public health, safety and welfare would be provided for by allowing the Church to install <br /> an electronic, illuminated changing message sign, which would be made possible if the <br /> Church property is rezoned from R-1 (Single Family) to B-2 (Community Business), and if <br /> necessary sign permits are sought and granted; and <br /> 2. The proposed rezone promotes the best long term interest of the Everett Community only if <br /> the proposal is supported through use of a development agreement; and <br /> 3. The approval as requested does not constitute a grant of special privilege to the proponent, due in part <br /> to the unique nature of surrounding commercial uses and zones and a protected abutting wooded <br /> area. <br /> - 2 - <br />
