NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Approval of Rezone, Section 2.020 of Ordinance No. 1671-89, as amended <br /> (EMC 19.02.020), is hereby amended as follows: <br /> 1. The zoning of the site is hereby changed from R-1 (Single Family) to B-2 (Community <br /> Business), (Exhibit A), for the area legally described in Exhibit B. <br /> 2. The zoning will be implemented with the attached Development Agreement (Exhibit C). <br /> Section 2: Conditions of Approval <br /> 1. Use of the site and sign design and function shall be subject to conditions and requirements of <br /> the Development Agreement attached hereto and incorporated herein. <br /> 2. Use of the Church property where the rezone will occur will be limited to church use only. <br /> 3. The illuminated, electronic changing message portion of the permanent sign be so designed, <br /> built and installed, as to have a non-changing lit background, on which non-transition-effect <br /> contrasting letters appear, and which will stay unchanged for a duration no shorter than one hour. <br /> 4. The intent of condition 3 above is that the sign shall not "flash" either its background or <br /> graphic elements. <br /> 4. Exhibits A, B, and C are hereby made part of this approval and incorporated herein by <br /> reference. <br /> 5. The Mayor is hereby authorized to approve and sign the Development Agreement (Exhibit C), <br /> containing Exhibits specified in Section(1) above, together with B-2 zone use restrictions <br /> specified in Section (2), item 2., and electronic, illuminated changing message sign appearance <br /> and operational provisions specified in Section(2) items 3., and 4. above . <br /> 6. Any and all sign changes and additions shall be in conformance with City standards unless <br /> otherwise provided for, as specified herein. <br /> Section 3: The legal description of the area affected by this action is: <br /> See legal description at Exhibit B. <br /> - 3 - <br />
