7 7
'PECIAL COUNCIL MEETING
December 11,1970
,Special Meeting of the Everett City Council was held at 10 a.m.,December 11,
1970. president Vogrild presiding. Upon rel/call it,ms found that all councilman were present.
Walt Sellers,Assistant City,Att.vney made the following comm..:
Th.meeting has been called to review a plat which was approved at the
meet„ T think this,meeting reeulted from a
newspaper article that vas written mincerning this plat, which I believe
printed on Tliursday yarning following elm Councilis action, which eaid
that the Everett City Council approves eleven low income family hooms.
/believe thee this heading misrepresents the facts. Ae a matter of
e' 3 feet the Councii aWOriered the sub-divieion of c.piece of propertY
and the purposee of the subdivision Ordinance;the things that were
iinosg siM ed consfdered by the.Council. For the approval of a plat, the applicant
ed3 Mi.,. must file application if,a subdivision where it goes before then...1g
ed wed,dt Commission. Thin plat went bdfore th.Planning Conmission in 1969.1.1
ddr'1' thete aaa•tentative enPreVel Prei.inary approvalfgiven to this
3,,defdd' ,plat Then in 1970,there was an extension granted by the Planning
ee''nei,33 Commission which brought it m,the Council for final approval this
Wednesday. I would like to point out that the purpose of the subdivision
Ordinance is to insure that the welfare of the City if taken care of in
'33e,ie.nee' those areas such as streets, water systems, zoning, sewage and drainage.
:Immo olf3 vat,. At the Council menting on Wednesday, the record ehowed that the City Engineer
Pm- who the adraidistrator of arainante seia that thin, plat
ei gedinnei compliedi with all sections of the cay of Everett subdivision Ordinance
e,e,dee regard to these matcr.end on.r matters.
3df eve''
nem.Tn.. On Wednesday afternoon,thie plat was filed with the'County,and I would 6
like to point oufdthe effect of this filing,is to meet this legally
subdivided plat. Now if Mie Council desires to change their action
na Taei en d taken on Wedneeday, the appropriate remedy ie for.an action by the
3dWievdePeu v 111 prosecuting Attorrmy mer sect..19,Chapter 271,laws of 1969,states
beecveda od— that the County Amlitor Shall refuse to accept any.plat for filing until
aPProvel of the p'at has been given by the appropriate legislative body.
Should a plat or dedication be filed without such approval.,the Prosecutin1
'anent:*'sdo g 4 1,1 be,, Attorney in the County inwhich the plat is filed shall file for a Writ
'"" '""'e :TteL2ir
•
film, the records of the unapproved plat or dedication of record.
3,1", It seems to bring an action that the Council would have to have cause
to allow the prosecutor to bring the Ifrit of Mandaums. I believe that the
.1' council's concern with this plat is Chat they were not informed that Om
houses to be consfnucted on the plat would be financed by,under the 235
Progrmv /t is my opinion that this method of financing is Irrelevant 1,
and iumaterial to Om stMdivision ordinance of the Cie,of Everett because
d3, the ordinance doesn't address itself to method of financing for any homes
that are constructed on subdivided land. For the Froaector to bring a
Mon, Mandate action it would seem.that we would require some cause or some
t
Y.
violation of the standards that have been set out.the aubdivision
subdivision Ordinance was violated inmome way,we could take this action if,
to the Prooecutor for each a legal procedure,
Councilman moor,.aa did',gime..the legality of the Plat end I
the Planning Comnission and out decisions, but 1m resented peraonally
• the feeling of finding out through the newspapers that it was a 235
aide.... We heee at this time, epproximately 1,500 235 homes in
this area,of which 10%are notnoccupied,roughlyul50. We have 50 of
these hmws that h ve never be o cupied, but,m have a surplus of
govennment houaing. Even[Hough we legally are bound to paws Ch.plat,
I think we Anhould have had the opportunity,to protest further'miste in
spending of Federal funds up to 114 million dollars in the area for
m government housing that is not necessary. I think somewhere this has
to behiought out to the public and to_these Federal officials that to
uar er of a million dollars in housing in an area where you
17ii:e°s:41ustbouses. We have 236 apartments that are sponeored by the
government chat are half filled, and still one construction in the
north end, and[hie ie a complete waste of public funds, and T thin.
