It has <br /> made directly to be based strictly on the impact <br /> by this applicant. <br /> Brad Cattle,representing the applicant,William R.Beaver, said the <br /> applicant will accept the alley vacation right-of-way dedication, <br /> will accept the conons on the DNS,but the burden of proof is on <br /> the applicant that the staff made a mistake by issuing the ONS. He <br /> reviewed the 26 separate conditions of the Determination of <br /> Non-Significance to mitigate the impacts of the alley <br /> vacation/realignment. Mr. Cattle stated the purpose of the review <br /> Is not to resolve all conflict but to mitigate the impacts to the <br /> satisfaction of the responsibl.official. <br /> Or. Cattle stated by affirming the DNS and granting the vacation, <br /> which is actually en alley realignment and lowering the alley to <br /> grade for ease of accessibility, the City will also derive some <br /> benefit. The vacation/realignment will also allow the proper <br /> development of this property. He urged Council to adopt the <br /> Findings and Conclusions as prepared by the Planning Staff and to <br /> affirm the Determination of Non-significance as Issued. <br /> Jim Jones, 2930 Wetmore, representing the appellant, Or. William <br /> Brost, stated that the traffic Impacts at the alst and Colby <br /> intersection have not been completely addressed and have not <br /> provided equitable mitigation for future grOyth of the surrounding <br /> area. He stated that Clty staff have misapplied the zoning oI <br /> ordinance In regard to the perking space requirements. <br /> Cr. Jones also stated that the problem of cueing cars while waiting <br /> Zeeng'pe Btr7".1=Bhrtl".°ItotnedfrTo'rg' ggg:fgrer.° <br /> Jones requested that the process be slowed down until flare issues <br /> can be properly addressed and that long term mitigation of the <br /> conditions also be considered. <br /> thecrust,1701 41st Street,stated he is in favor of development of <br /> the area but feels that future development should not be hampered by <br /> the incomplete mitigation of the development impacts of this <br /> property at this integral intersection in the City. He stated that <br /> the vacation has an adverse Impact on the area, that not enough <br /> information or complete information hes been reviewed and planning <br /> on and off the site has not been complete. <br /> Bob Landles,Planning Staff, stated the Navy traffic study was also <br /> considered in the DNS and all reasonable traffic studies were used <br /> O in the Determination. The fencing and screening issues were also <br /> addressed in the DNS.
