CONCOMITANT AGREEMENT AMENDMENT <br /> ,,:I If j, mary Cunningham, planning Start, stated in 1986, the City Council <br /> L. approved a rezone of the Prince of Peace Lutheran Church property <br /> ..!1., ,L' from R-S to 8-2 with a concomitant agreement. The concomitant <br /> agreement required that street improvements to 19th Avenue SE be <br /> f: ,I completed prior to recording the rezone. The church requests that <br /> condition 4a of the concomitant agreement be revised to allow street <br /> improvements to be provided at the time of issuance of e building <br /> permit for the parcel which fronts on 19th /Nen. SE rather than <br /> .I prior to recording ot the rezone. The Planning Commission <br /> recommends approval of the proposed amendment. <br /> I 11, moved by Councilmember Pope, seconded by Councilmember tangos to <br /> authorize the Mayor to execute an amendment to the Concomitant <br /> I 4'' Agreement with Prince of Peace Lutheran Church. <br /> 1 Cunningham stated that they would be required to do the street <br /> improvements when there was construction on parcel 1 that fronts on <br /> 19th Avenue 6E. They have no plans at this time to do any <br /> construction on this parcel or to sell the parcel. <br /> CounCilmember Gipson inquired it there is any movement for <br /> construction by Prince of Peace Church on any of their property, <br /> would the improvements Co 19th Avenue SE be required. <br /> ; 1, t,"IV Ms.Cunningham stated it Na her understanding that the church plans <br /> to do some construction on parcel 2 and there Na no condition et <br /> .A '' this time that requires the street improvements be completed. The <br /> requirement for street improvements applies to parcel I only, which 1 <br /> fronts directly on 19th Avenue SE. <br /> ,Ir I#'1 ' Louncilmember Overstreet asked if this <br /> 1would create a break in <br /> II'',4'4 I r.,,, improvements on 9th Avenue if the property remains undeveloped. <br /> Jim Iles,Assistant City Attorney,asked if a copy of the amendment <br /> concomitant agreement was included in the packet.
