A nonconforming lt vs a lot which does not met the minimum lot area and/or width requirements of the zoning code, <br /> but which was created prior to the effective date of zoning. The <br /> 1956 zoning Code provided 7,000 square Peet for 1 zone and the R-S <br /> c <br /> zone was added 1n the 1964 zoning ode revision. co e. <br /> The Planning Commission Telt that the Nearing E 1 r' ruling <br /> opened a loophole which is ca trary to the intent f the <br /> to <br /> In <br />. an effort to close the loophole,the PlanningCommissiondecided <br /> propose a immediate amendment to the zoning <br /> code. At the August 9, <br /> 1988 public hearing to consider the E ordinanceamending <br /> alternative <br /> the <br /> zoning code,t alternatives were presents <br /> instituted a merger clause which gives staff the authority to apply <br /> a <br /> the zoning code s it had prior to the Hearing Examiners ruling; <br /> the second alternative proposed a merger clause but added provisions <br /> for some flexibility to allow further development of some <br /> nonconforming lots. The Planning Commission decided to approve the <br /> first alternative fax immediate passage i o the existingcode and <br /> directed staff to address the secondalternative to the context of <br /> proposed update andrevision of the entire Zoning Cade. <br /> Mary Campbell, 980 NM Camano Drive, Camano Island, informed the <br /> Council that she had purchased a substandard lot on Maple in July of <br /> this year. She has applied forcertification of the lot so that she <br /> will be able to build n it and her certification has been refused. <br /> She spoke in opposition to adoption of the merger clause. <br />
