S28 <br /> December 28,1988 <br /> BID CALL <br /> To call Par bids for the Evergreen Branch Library. Bids to be <br /> received until 2:00 p.m.January 19,1989. <br /> Roll was called with all councilmembers voting yes except President <br /> Nova who was excused. <br /> Motion carried. <br /> PUBLIC HEARING-REFORMATION OF LID 720 <br /> Bruce Jones, City Attorney, said this was the public hearing an the formation of LID TRT,w ter,sewer and street improvements to 16th <br /> Ave. <br /> evidence <br /> S.E.E. No formal rules of idence will control these <br /> proceedings, but the hearing will be conducted the sameas any of <br /> he regular meetings. <br /> He said everyone who owns property In the proposed LID or who is <br /> authorizedto represent such property ow erwill be given an <br /> opportunity to be heard. However, all protests should be In the <br /> hands of the City Clerk in writing at this time. He asked if any <br /> propertys orepresentative objected to any couneilmember's <br /> participationin these proceedings. No one replied. <br /> Mr. Jonas stated the primary purpose of this hearing is Par the <br /> council to consider whether to <br /> form this L As part of that <br /> process,individual property o will be g an opportunity to <br /> present evidence and information to the City Council explaining the <br /> reasons they for or object to the reformation of this LID. <br /> Began Jones, LID coordinator, said since May of 1988, progress on <br /> the 16th Ave.SE project,LIO 707 has been somewhat stifled due to <br /> two of controversy: 1, rising estimates and <br /> questionsc about which property o should o be justly compenatted <br /> Por their rights OP way. oP this, the council recently <br /> directed staff to reopen the thirty-day protest period. <br /> In the process of reforming the LID,the new preliminary assessment <br /> roll has been calculated on the bast"0f a using the lower of <br /> s <br /> two estimates of total c recently generated or $2,025,000. By <br /> using this estimate,Staffhast assumed that the LID would purchase <br /> only those rights of way thawore originally intended to be <br /> Curchased, and not those presumed to be dedicated through <br /> ancommitant agreements. <br /> Bruce Jones asked <br /> the staff report, pages 99 through 121 be <br /> placed In the record at Exhibit II. <br /> said <br /> right-of-wayissue put[ city in a bit of a quandary. <br /> Some d the <br /> property o a <br /> , before the LID was formed, requested <br /> o <br /> end obtained a rezone of their property to "C-2 with contract" <br /> ��. zoning classification.
