If that property owner has <br /> filed a protest,the City staff shall be entitled to respond. } <br /> President NSva stated that no formal rules of evidence will control <br /> the hearing. The hearing is not intended to be a question a <br /> a session, but instead, is the final opportunity for t owner <br /> of Par el IA to present evidence or information to the hCouncil <br /> before action is taken to confirm that assessment and the final <br /> assessmentnature ' <br /> roll. This is not the time to ask questins bout the <br /> of the project or the improvements that have been installed, <br /> unless those questions relate specifically to the amount of the <br /> assessment <br /> m nt which the City proposes to levy. <br /> The general presentation made by the City staff at the hearing on <br /> February 8, 1989, rgarding the nature of the LID, the special <br /> assessment process, and the preparation f the final assessment <br /> roll, together with related a'hibits submitted by the City Staff, <br /> re incorporated by reference into this proceeding. 9X <br /> President Niva asked the City Clerk to read the protest submitted by <br /> Hd MV Associates,property owner o4 Parcel IA. The letter was from <br /> Martin obrnett, attorney for the property owner. The objection to <br /> the final assessment on its property w detail <br /> ed In 13 specific <br /> s <br /> Points. The protest letter w entered was <br /> the record as Exhibit <br /> Mr. Robinett stated H d MV Associates. assessment was raised by <br /> n <br /> $108,000 at the last hearing and he felt that a deal had been made <br /> theor unnduessmenpreseure had been puton City staff to get them to change <br /> Brian Jones,LID Administrator, reviewed the reasons for the change <br /> of the assessment amount and the discovering orthe inconsistency f �¢'i <br /> Mx.Macaulay,analysis in segregating the ss Bement between Parcel <br /> cx <br /> 0 and Parcel AA.
