172 • <br /> Apri1.10,1991 <br /> 4:1 <br /> The third amendment to the contract rezone changes the <br /> locations of some buildings in Phases I and II of the <br /> development of the Claremont Village Shopping Center from 47th <br /> to 50th Street, on the east side of Evergreen Way, Everett, <br /> Washington. <br /> In addition, the amendment requests changes for the permitted <br /> uses, parking, landscaping, and signing. It is the intent of <br /> the applicant to make these changes in order for the project to <br /> be consistent with the City of Everett's Zoning Code, adopted • <br /> on January 13,1,90. <br /> A hearing on the request was held before the Hearing Examiner <br /> of the City of Everett on February 14, IGG1. The Hearing <br /> Examiner recommenddd that the contract rezone be amended to <br /> allow revisions of locations of buildings in Phases I and II of <br /> the development at the Claremont Village Shopping Center with <br /> minor changes in landscaping requirements, uses, and parking as <br /> set forth in specified conditions and recommendations. <br /> Don Wood indicated the neighborhood was-supportive of this <br /> rezone however was adamant that Wilmington Avenue be closed. <br /> President Borrow asked for public•comments. No one replied. <br /> Wooed by pTiv=inre, seconded by Councilman.Gipson to <br /> Roll was called with all councilmen voting yes except <br /> Councilman Anderson who was excused. <br /> Motion carried. <br /> Councilman Gipson stated he was concerned about the street <br /> closure as the street had just been upgraded. <br /> City Attorney Bruce Jones also voiced legal concern about • <br /> closing Wilmington Avenue. He directed Council to look at item <br /> Oil in the Hearing Examiner's decision which said that "the <br /> final site plan review shall consider in its final design of <br /> the center the closure of Wilminif&T—Genue at or near the east <br /> end of the street." He also told councilmembers that in Order <br /> for the street to be closed it would have to come beck to <br /> Council for their consideration. <br /> 0 <br /> • <br />
