202 <br /> CMay 1,1991 <br /> Mayor cinch expressed the need for flexibility as some tenants <br /> are looking at other alternatives: <br /> • <br /> • <br />• RESOLUTION-LEASE AMENDMENTS <br /> 0 Moved by Councilman Pope, seconded by Councilman Diamond to <br /> adopt Resolution No. 3464 authorizing.the Mayor to negotiate <br /> and execute lease amendments of the Mall Street Building and ' <br /> ri c Culmback Building as follows: <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY of EVERETT. <br /> 1. The City Council affirms and directs that it is the City's <br /> intent to begin occupying the'Mall Street Building between <br /> mid-1993 end mid-1994. Further, the City Council recognizes <br /> that some leases with private tenants and extension options go <br /> beyond the City's time frame. said options will require <br /> extensive negotiations and possihle legal action with the <br /> private tenants to accomplish the City's schedule. <br />• <br /> 2. The Manor is authorized to negotiate and execute lease <br /> amendments with existing privet" tenants of the Culmback <br /> Building and Wall Street Building, provided that said <br /> amendments shall be approved by the Budget Committee and no <br /> lease amendment shall extend the stated term of the lease. <br /> Leases with new tenants a e discouraged and shall be <br /> mulled to c ncil approval'only.r <br /> Councilman Moser was opposed as he didn't want several moves. <br /> Attorney Jones felt the Budget Committee should be aware of any <br /> revenue impacts. <br /> Councilman Overstreet questioned the usage of "shall" in f2, ! <br /> line 3 of the resolution and felt it should be"may." <br /> Bruce said that if Budget'Committee wanted to bring it before <br /> Council they could do that at the Budget Committee's discretion. I <br />• <br /> Councilman Gipson stated that.the Budget Committee has always <br /> been sensitive to such issues and when in doubt would recommend <br /> it be brought before Council. <br />
