C 319 <br /> tC' June 26,1991 <br /> Dennis Collins, proponent, stated,he wasn't aware of any <br /> opposition to this vacation and that.he was willing to <br /> cooperate with the neighborhood. He said he had no intention <br /> of building on the property but wanted to clean it up. <br />• <br /> Gloria Velia, 6214 Rockefeller, stated she had signed the <br /> petition opposing•the vacation; however, didn't know what the <br /> proponent's intentions were. She asked if there was any way to <br /> keep the pedestrian pathway as a condition of the vacation. <br /> President.Morrow suggested that there could baa resolution to <br /> A •this worked out between the neighborhood and Mn.Collins. <br /> Moved by Councilman Overstreet, seconded by Councilman Moser to <br /> continue Us public hearing Grimes public meeting is held <br /> between the neighborhood end Mr.Collins to resolve this issue <br /> with the public hearing to resume no later than July 24,1991. <br /> Roll was called with all councilmen voting yes except <br /> Councilmen Gipson and Diamond who were excused. <br /> on carried. <br /> J. No one replied. <br />• <br /> Jg Craig Fullerton, Public Works, stated the proposed vacation <br /> contains an area of approximately 1,250 square feet and is <br /> within the R-1 zone. The vacation is proposed to enlarge a <br /> single family building lot for landscaping and parking. The <br /> requirements set forth by law have been met, in that a valid <br /> petition has been received with a valid number of signatures <br /> end written notice Of public hearing have been posted as <br /> required. To date, there have been no protests ort this <br /> vacation. He recommended City Council approve the vacation of <br /> that portion of xayier way, north of BAtn, south of SR-526 <br /> subject to: 1) payment for an independent appraisal; 2) <br /> payment of 1/2 Inc appriased value; and 3) easements to be <br /> retained for future and existing utilities within the proposed <br /> vacation. <br />!
