404 0 <br /> August],1991 <br /> O <br /> PRESIDENT,COMMENTS <br /> President Morrow introduced a resolution relating to the <br /> scheduling and procedures for the SEEM Appeals Hearing on the <br /> Boeing expansion. <br /> City Attorney Bruce Jones reminded Council that they are acting <br /> as a quasi-Judicial body in this appeals hearing. He further <br /> told Councilmembers that all information they receive should be O <br /> given to the City Clerk and Planning Department so that it is <br /> included in the record. He discussed with councilmembers the <br /> possibility of appeal withdrawals. He indicated that if the <br /> terms <br /> Of withdrawal involved changes in the decision document, <br /> the Council should hear all the testimony andcnclude the <br /> hearing before making any changes Or agreeing to do so. <br /> President Morrow commented a a letter received bye appellant <br /> registering dissent regarding scheduling and procedures for the <br /> hearing process of the Boeing EIS. He responded as follows: <br /> 1. This procedure has been under way for over 17 months. The <br /> raft EIS (which contains all the technical materials) was <br /> issued on April 15. <br /> 2. There is no limitation on submittal of written materials. <br /> 3. Fairness is an ho all parties,to the public, to the <br /> applicant, to the o CityCouncil, to the staff and to other <br /> parties involved. This order organizes the hearing such that <br /> all parties have an opportunity to address their issues. <br /> There are appellants hgwever there Ss only e <br /> objectlon toe proposetl op =in Lerma of time limita[lans,on <br /> 5. No procedure will satisfy all participants. <br /> 6. This is the most time this Council has ever granted to a <br /> hearing Of this nature. <br /> ]. The State and Federal Supreme Courts require only 30 O <br /> minutes fax oral arguments. <br /> 8. All parties, including the City, are under the same time <br /> constraints. <br /> Councilman Overstreet made a comment that there w ening <br /> sessionsscheduled. President Morrow responded that notice of <br /> e <br /> the hearing schedule was given timely and that hearings are O <br /> usually held during the day. <br /> 0 <br />
