404 0 August],1991 O PRESIDENT,COMMENTS President Morrow introduced a resolution relating to the scheduling and procedures for the SEEM Appeals Hearing on the Boeing expansion. City Attorney Bruce Jones reminded Council that they are acting as a quasi-Judicial body in this appeals hearing. He further told Councilmembers that all information they receive should be O given to the City Clerk and Planning Department so that it is included in the record. He discussed with councilmembers the possibility of appeal withdrawals. He indicated that if the terms Of withdrawal involved changes in the decision document, the Council should hear all the testimony andcnclude the hearing before making any changes Or agreeing to do so. President Morrow commented a a letter received bye appellant registering dissent regarding scheduling and procedures for the hearing process of the Boeing EIS. He responded as follows: 1. This procedure has been under way for over 17 months. The raft EIS (which contains all the technical materials) was issued on April 15. 2. There is no limitation on submittal of written materials. 3. Fairness is an ho all parties,to the public, to the applicant, to the o CityCouncil, to the staff and to other parties involved. This order organizes the hearing such that all parties have an opportunity to address their issues. This is the most time this Council has ever granted to a hearing Of this nature. ]. The State and Federal Supreme Courts require only 30 O minutes fax oral arguments. 8. All parties, including the City, are under the same time constraints. Councilman Overstreet made a comment that there w ening sessionsscheduled. President Morrow responded that notice of e the hearing schedule was given timely and that hearings are O usually held during the day. 0
