Abusive language, <br /> cattacks, <br /> rlis ustering or interruption dP a speaker by O <br /> lapping ing <br /> Mr. Sellers recognized Sue Tanner, Deputy Prosecuting Attorney <br /> Por Snohomish County. Ms. Tanner presented Snohomish County's <br /> Conditional Withdrawal of Appeal. She said discussions between <br /> the County and City resulted in a stimulation between the <br /> CouCount wind t its the City's Responsible official_ that the County <br /> appeal, provided that Snohomish County has <br /> flexibility in utilizing the transportation funding and <br /> revisions to the makeup of the Boeing Mitigation Committee. <br /> The withdrawal is conditional upon acceptance. <br /> Mr. Sellers recognized Richard E. McCann, Attorney from the <br /> Perkins' Coie firm representing the applicant, Boeing. Mr. /-^* <br /> McCann introduced a Motion to Dismiss Certain Claims for Lack \.1 <br /> of Standing. Mr. McCann stated that the Boeing Company moved <br /> to dismiss appeals of the following parties for lack of <br /> standing: (a) Snohomish County Alliance to End Homelessness; <br /> (b) Betsy Blair; (c) George Smith; (d) Etta Southern; (e) <br /> Friends ofResponsible and Orderly Growth Society; (f) Citizen <br /> ocatesfor Responsible Development; (g) Visiononal ohomish <br /> CountField Gun(Club, astoallsusCounty <br /> nisImprovement othernthanrecretio <br /> Alliance; Paine <br /> trap <br /> shooting;and(j)Streamkeepersof Everett and Snohomish County. <br /> Mr.McCann explained the administrative process is not designed <br /> to modate the objection of every citizen to every action <br /> of governmental representatives. Guidelines have been adopted <br /> by statute andthrough comma n law e <br /> which limit acc s to the O <br /> appeals process. Mr. McCannstated that the named appellants <br /> cannot satisfy applicable standing rules with respect to the <br /> issues they raise. He asked that their appeals be dismissed. <br /> He also submitted Voir Dire for various appellants. <br /> Assistant City Attorney Jim Iles said that the Motion to • <br /> Dismiss will be taken under advisement and reserve the ruling <br /> until later in the hearing. <br />• <br /> 3 <br />
