Further <br /> it was considered that with more time to obtain permits for <br /> utilization sites, prices possibly would be more favorable to <br /> the City. <br /> In discussions with Sant-Agri, it was represented that Sani-Agri <br /> would waive its right equitable adjustment due to <br /> decreasedquantities, and Sani-Agri would stay with its original <br /> bid prices. <br /> anl-Agri Was willing to subcontract with an experienced <br /> dewatering contractor or to go ahead on the basis of its bid <br /> (leased equipment with experienced workers). The cast factor is <br /> the most difficult. Although it is possible prices would <br /> improve with more time for site permitting, there is no <br /> guarantee. In staff's judgment,it is preferable to stay on the <br /> time schedule established and take the prices that are in the <br /> bid. ' <br /> Mr. Olivers stated that staff recommends that Council award to <br /> the law bidder, Sani-Agri, subject tSani-Agri's <br /> C <br /> representation, that it will w n <br /> its rights to a equitable <br /> adjustment under Section 1-04.6 waive <br /> to the decreased quantities <br /> of 2000 dry tons,rather than the estimated 4000 Cry tons. <br /> 'Staff also recommends that Sani-Agri should be strongly urged by <br /> Council, but It is not required as a condition of award, to <br /> subcontract for dewatering (for thethat the City <br /> believes that subcontract will achieve <br /> higher level of <br /> management responsibility for dewatering that will benefit both <br /> the City and <br /> Sani-Agri). Also that the award to Sant-Agri, or <br /> any other contractor, is'made on the understanding that the <br /> contractor is expected by the City to be responsible far being <br /> sensitive to and assuring that the regulatory conditions <br /> applicable to any permitted sites where City bio-solids are <br /> utilized are met. <br /> Pat Brown, 5900 Columbia Center, Seattle, representing Mobile <br /> Dredging, stated the apparent low bidder, Sani-Agri obtained an <br /> unfair advantage by failing to list its subcontractor with the <br /> bid submittal and that Sans-Agri is not a responsible bidder as <br /> they e incapable of performing the dewatering portion of the <br /> me, t. <br /> Bruce Jones, <br /> Assistant City Attorney, ststed that Sani-Agri was <br /> responsible bidder and that no unfair advantage had been given <br /> to this.firm. <br /> C <br />
