He asked that participants speak <br /> only from the speaker's microphone and begin by stating their <br /> name and address and to keeptheir comments as brief and <br /> concise as passible. He said a court reporter was present and <br /> would be recording the testimony provided. <br /> He aas aced that he would be acting chairperson,for this <br /> hearing. The hearing is to be fair in substance and form and <br /> Pair in appearance as well. He asked if any councilmember had <br /> any conflict which should cause that member, to avoid <br /> participation in this hearing. <br /> Councilman Overstreet stated, for the record,that he attended <br /> his neighborhood meeting .where Burlington Northern presented <br /> information on their tower siting. Mr. Overstreet said the <br /> informationery general in nature and he did not <br /> participate inaany very <br /> about the project. /1 <br /> ) <br /> Mark Stowe, representing the appellant, Lowell Civic <br /> Association, entered an objection to Councilman Overstreet's <br /> participation in the hearing due to the appearance of fairness <br /> doctrine. <br /> Robert E. Malkley, representing the applicant, Burlington <br /> Northern, stated that Burlington Northern attended the <br /> neighborhood meeting at the request of the Planning <br /> Department. The purpose was to inform the neighborhood of the <br /> tower siting process end to asany questions. They w <br /> not attempting to indoctrinatethen public on this issue. Mr. <br /> walkley said they have no objection to Councilman Overstreet's <br /> participation in the hearing. <br /> Councilman Overstreet reviewed the substance of the meeting of <br /> the Northwest Everett Neighborhood meeting of two months ago. <br /> Nothing that was discussed or information made available at the <br /> meeting whichhas not been included in the Council packet <br /> materiels. He stated that he could be open and fair and not be <br /> predetermined to the decision that would be required of Council. <br /> 0 <br />
