Gail Chism, <br /> Chair of the Lowell Neighborhood,and Mark Salts, Chair of the <br /> Northwest Neighborhood,also reported on the meeting. <br /> Lee Rampley, of Burlington Northern, explained that he <br /> presented the Program to the neighborhood meeting at the <br /> request of the City's Planning Department, and reviewed the <br /> substance of the meeting. <br /> Jim Iles, Assistant City Attorney, explained that Councilman <br /> Overstreet may participate in the hearing as he stated he could <br /> be fair and unbiased in reaching a determination. <br /> Vice President Anderson proclaimed that the hearing would <br /> continue and Councilman Overstreet would participate in the • <br /> hearing. <br /> He said that the purpose of the hearing is for Council to hear <br /> and consider facts relating to the SEPA of the appeal of the <br /> Burlington Northern project. He stated that staff would have <br /> 15 minutes for their presentation and the appellant, the Lowell <br /> Civic Association,represented by Mark Stowe and the applicant, <br /> Burlington Northern, represented by Robert E. Walkley, will <br /> each have 05 minutes for their respective presentations. Five <br /> minutes will be provided for rebuttals or closing remarks from <br /> each party. <br /> Vice President Anderson announced that all cross examinations <br /> will be handled through the Chair. He confirmed that all <br /> individuals who wished to testify were sworn under oath by the <br /> City Clerk. <br /> Gerry Ervine, Planning Department, stated that the City <br /> received an application from Burlington Northern Railroad, c/a <br /> Miles Christensen,St.Paul Minnesota, for the construction of <br /> an 80 foot high, self supporting communications tower with a <br /> 16' x 10' x 8' equipment shelter for railroad communications <br /> services. The microwave tower will be located within the <br /> Lowell neighborhood. The Lowell neighborhood is bounded by I-5 <br /> Na the west, 41st Street to the north,and the Snohomish River <br /> to the east. After review of an environmental checklist, a <br /> geotechnical report and an FCC report titled, •Ocestions a. <br /> Answers About Biological Effects A. Potential Hazards of <br /> Radiofrequency Radiation," and comments received, the city <br /> issued a determination of Non-Significance (DNS) on March 20, <br /> 1992. An appeal of the DNS was received on April 3,1222,from <br /> Mark Stowe,attorney representing the Lowell Civic Association. <br /> • <br />
