384 <br /> October 21,1992 / <br /> BIO AWARD <br /> Moved by Councilman Pope, seconded by Councilman Anderson that <br /> the contract for the Mater Filtration Facilities Phase I Plant <br /> Expansion project be aw rded to the low bidder, IMCO General <br /> Construction, Inc., Bellingham, based upon their proposal and <br /> unit bid of unit prices extended for the estimated total of <br /> $6,204,250 including Washington State sales tax asreceived at <br /> the bid opening held at 2,00 p.m.,October 1,1992 <br /> In reviewing the bids, it was observed that IMCO was the only <br /> bidder who did not specify Roberts Filter Mfg. Coto produce <br /> the ir'scour system. IMCO's failure to specify Roberts w <br /> questioned by McClure and Sons, Inc. (the fourth low bidder). <br /> advised pcificsince sat were reviewed <br /> swith the City Legal Dept. who <br /> spec provided Roberts" equal" <br /> e <br /> that it will b IMCO's obligation to provide a air scour <br /> system equal toor better than the Roberts system. IMCO has <br /> assured the City that it can do so. <br /> • <br /> Roll was called with all councilmen voting yes except <br /> Councilmen Moser who was excused. <br /> Motion Carried. <br /> APPEAL-SUBDIVISION ALTERATION 41-91(GENE LILLEY) <br /> The City application from TeThe <br /> Walter rvL <br /> see nlot subdivision alteration. <br /> Examiner <br /> reviewed and approved the alteration on June 19, 1992. Gene <br /> billed asked for reconsideration of the Examiner's decision, <br /> stating that the City does not have the means or the funds to <br /> nage and maintain trees and vegetation in an Environmentally <br /> Sensitive Area for' protection f'views of adjacent property <br /> owners. The reconsideration was denied by the Examiner on July <br /> 17, 1992. On August 6, 19092, Appellant Gene Lilley filed an <br /> appeal on these same issues to the Everett City Council. The <br /> City Council, at a public meeting on September 16, 1992, <br /> reviewed the public record, determined that theeord <br /> contained n erroneous procedure or substantial error in fact <br /> or law,and denied the appeal. <br /> The Council needs to adopt a resolution specifing the findings <br /> of the public meeting. <br /> 0 <br />
