477 December 16,1992 President Gipson stated that now that all the testimony had been heard end all the documents have been reviewed, it is time for Council to consider two basic issues: whether the information is adequate to make a SEPN determination; and o the basis of that information, is there a probable significant adverse environmental impact. The action required of Council is to affirm the MDNS; remand it to Staff to generate additional information{ recommend preparation of an EIS, or make additional findings an,m based on those findings, revise the MONS. Moved by Councilman Overstreet,seconded by Councilman Campbell to modify the Environmental Determination for a Special Use Permit for Rubatino Container Storage and Transfer Facility and adopt findings,conclusions and a decision denying the appeals on all ether issues as detailed in Resolution No.3710. Discussion w s held on the various issues of appeal and the modification of the MONS. Moved by Councilman Campbell,s onded by Councilmen Diamond to emend the modification by adding; Condition 64 under Mitigation Required by Existing Codes 0 and Ordinances, is hereby modified to read as follows, i / "Either containers must be leak-free, with close fitting the Applicant must provide industrial pretreatment of stormwater runoff if containers are not covered." Roll was called with all councilmen vot'ng yes.
