rDecember16,1992 ems <br />' C.., WHEREAS, the City Council reviewed the staff report In this <br /> matter and heard statements from the appellants and city staff <br /> concerning the appeal; <br /> NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT that the Responsible Official's decision is hereby <br /> modified, and that the appeals of Ed Rubatino and the Greater <br /> Riverside Neighborhood Group are denied with regard to all <br /> Other issues. The following findings and conclusions are made: <br /> (THE FINDINGS AND CONCLUSIONS IN TOTAL ARE ON FILE IN THE CITY <br /> CLERK'S OFFICE.) <br /> AND FURTHERMORE, City Council hereby modifies the Mitigated <br /> Determination of Nen-Significance (136-92) in the following <br /> 1. Condition f6 under, Mitigation of Adverse Impacts <br /> by SEPA, which requiresa fence along the <br /> Orth/south alley where it abuts the property <br /> located et 2T1T Harrison Avenue,is hereby deleted. <br /> 2. The following condition is hereby added under, <br /> lMitigation inloading/rec <br /> f Adverse Impactsby <br /> by activities Trmukt <br /> 4 involved <br /> access• the loading dock from the south side ofthe <br /> recycle transfer buildieg, rather than directly <br /> off the alley. The loading dock must be located <br /> on the south side of the building." <br /> 3. Condition t0 under Mitigation Required by Ekistir.g <br />• Codes and Ordinances, is hereby modified to reed <br /> as follows: "Either containers must be leak-free, <br /> with close fitting covers, or the Applicant must <br /> provide Industrial pretreatment of stormvater <br /> WeehI <br /> runoff if containers are not covered." <br />• Roll was called with all councilmen voting yes except <br /> Councilman Moser who voted no. <br /> 6 Motion carried. <br /> 0 <br />'i <br />
