Febmary 2,2000 <br /> AGREEMENT-BURLINGTON NORTHERN AND SANTA FE RAILROAD <br /> This item was puled from the agenda. <br /> SUPPLEMENTAL AGREEMENT-SOUND TRANSIT/PACIFIC AVENUE <br /> OVERPASS PROJECT <br /> Moved by Cmmelhnembee Anderson, seconded by CounALnember <br /> Overstreet to authorize the Mayor to negotiate and sign a supplemental <br /> agreement to the Memorandum of Agreement with Sound Transit for <br /> funding,design and construction of the Pacific Avenue Overpass project. <br /> Sound Transit is the lead agency for We Pau0c Avenue Overpass project.The <br /> project will be under construction in the summer of 2000.This will coincide <br /> with the Everett Station's c0asirttmion time period.Sound Transit and the City <br /> have determined Nat it is in their mutual interest to have the City manage the <br /> project and be responsible for the permitting,comtrucuon and project <br /> mamgemem. <br /> The supplemental agreement outlines in pmt the roles and responsibilities of the <br /> City and Sword Transit and project loading and payment procedures. Project <br /> funding includes a reimbursement of the cost of City staff time associated with <br /> construction management activities. <br /> Couneilmember Gipson question.whether the City would be liable for We <br /> costs involved in relocating the s00City utilities. <br /> Peter Camp,Legal,stated that the PUD will pay foe the costs of moving Weir <br /> own facilities. <br /> Councilmember Gipson expressed concern regarding who would be responsible <br /> for payment of cost ovemuss on the project and Be split of liquidated damages <br /> between the City and Sound Transit. <br /> Cie <br />
