Lmy 25,2001 <br /> testimony phase of the hearing.The balance of the hearing will be co...until <br /> August 22,2001. <br /> Councilmember Pope expressed concern regarding closing the public hearing <br /> today. <br /> Blair Burroughs,Special Counsel,stated that the intent was to take all of the <br /> protests end public testimony today,and then close the public testimony portion of <br /> the heating.He commented'that it is important that all protests be filed today <br /> even if the public hearing is continued. <br /> City Attorney Soine remarked that the City Council can choose to close the public <br /> hearing today,close the protest period today but leave the testimony open in <br /> respect to the protests filed,or continue the public hearing without closing the <br /> protests in which case individuals could submit written protests up to and through <br /> the continued public hearing. <br /> Councihnember Campbell questioned what the deadline was for filing a protest. <br /> Attorney Some stated that they have until the end of the hearing today. <br /> Blau Burroughs stated that he has neves been involved in an LID heating where <br /> the Council decided to take protests other than at the initial phase of the hearing. <br /> Previously,it has been required that all protests be Bled on the day that the <br /> hearing opens. <br /> Councilmembe Campbell expressed coram regarding limiting public testimony. <br /> He suggested that the public hearing be motioned and that the time for filing a <br /> written pmteat be extended to 5:00 p.m,today. <br /> Blair Boroughs spoke regarding the Local Improvement District process.He <br /> stated that if the improvements which are made increase the propefe'fair <br /> market value,the City can levy their costs against the properties.Normally,the <br /> hearing is held,the LID is formed,the improvements are completed and then the <br /> assessment roll is confirmed.This LID is unusual in the respect that the final <br /> assessment rolls are being confirmed before the improvements are started. <br />
