May4,2005 <br /> COUNCIL BILL NO.0504-12 <br /> THIRD AND FINAL READING: <br /> AN ORDINANCE amending Ordinance No. 1671-89, as <br /> amended(EMC 19.02.020),amending Ordinance No.2107-95 <br /> (EMC 19.22.020),and rezoning a portion of the east side of <br /> Rucker Avenue between Everett Avenue and Pacific Avenue <br /> from C-1(General Commercial)to B-3(Central Business <br /> District) <br /> Moved by Council Member Hatloe seconded by Council Member Olson <br /> that this is declared to be the third and final reading of Council Bill No. <br /> 0504-12. <br /> Moved by Council Member Olson,seconded by Council Member <br /> Nielsen to amend the motion adding a new Section 2A to the <br /> proposed ordinance stating that"any property development in the <br /> rezoned areas identified above shall be subject to development <br /> standards which may be adopted by the City prior to approval of any <br /> construction permits." <br /> Allan Offen,Planning Director,requested clarification regarding the intent <br /> of the amendment. <br /> After considerable discussion,Council Member Olson withdrew his <br /> proposed amendment and Council Member Nielsen withdrew his second. <br /> Moved by Council Member Nielsen,seconded by Council Member <br /> Stonecipher to amend the motion by substituting the following <br /> provisions for Sections 1 and 2 of the proposed ordinance:rezone <br /> the property to B-3,authorize the Planning Director to prepare a <br /> development agreement for review by the Planning Commission and <br /> City Council,once approved,the development agreement would be <br /> binding and any developer who was proceeding under It would have <br /> the lull right to proceed with the project under the terms of the <br /> development agreement,the development agreement will include <br /> provisions that limit the maximum height of any structure on the site <br /> 131 <br />
