It would further provide that the <br /> provisions of this proposed ordinance that allows an Increase to 150 <br /> feet when accompanied by a development agreement would expire <br /> upon the adoption of a downtown plan.At the time a downtown plan <br /> is adopted,any developer who has entered into a development <br /> agreement has the option of proceeding under the development <br /> agreement, or if the developer chooses, proceed under the <br /> applicable zoning and standards that are adopted in the downtown <br /> plan. <br /> Aker further discussion,Council Member Nielsen withdrew the condition <br /> in his amendment requiring that a portion of the residential units be <br /> created as condominiums. Council Member Stonecipher agreed to the <br /> deletion. <br /> EXECUTIVE SESSION <br /> City Attorney Iles requested an ecutive session regarding a potential <br /> litigation matter.The City Council meeting recessed and reconvened. <br /> Roll was called on the amendment to the motion with all council members <br /> voting yes except Council Members Hatton.Olson,Gipson and Krell who <br /> voted no. <br /> Motion failed. <br /> Moved by Council Member Gipson,seconded by Council Member <br /> Overstreet to remand the proposed rezone back to the Planning <br /> Commission. <br /> 132 <br />
