November 16,2005 <br /> Security's Office of Domestic Preparedness for the distribution of <br /> preparedness equipment. <br /> Roll was called with all council members voting yes. <br /> Motion carried. <br /> PUBLIC HEARING—NORTH MARINA REDEVELOPMENT <br /> President Krell opened a public hearing regarding a proposed resolution <br /> amending Resolution No.5382,and amending Exhibit C of Resolution No. <br /> 5382,the development agreement for the Port of Everett North Marina <br /> Redevelopment Planned Development Overlay Zone. <br /> President Krell stated that it is important that the public hearing is not only <br /> fair in fact but fair in appearance. She requested that each council <br /> member disclose whether or not they attended the story pole <br /> demonstration on October 8.2005,or if they otherwise viewed the story <br /> pole. Council Members Krell, Olson, Hatlae, Gipson. Nielsen, <br /> Stonecipher and Overstreet each disclosed that they had either attended <br /> the demonstration or viewed the story pole.Council Member Gipson also <br /> disclosed that he had discussed them as part of a conversation during his <br /> campaign for Mayor and had stated his position. <br /> President Krell questioned whether any council members knew of any real <br /> or potential conflict or concern with this matter that would cause that <br /> member to avoid participation in this hearing. <br /> Council Member Overstreet requested that the City Attorney review the <br /> criteria for making that decision.City Attorney Iles staled that it is based <br /> on whether or not the council members have had any ex parte contacts <br /> regarding the merits of the proposal and,if so,whether the council <br /> member is still able to maintain a fair and objective view of the matter. <br /> Council Member Overstreet stated that he had recused himself from the <br /> previous meeting regarding this matter due to concern that the public <br /> would feel that his decision would be biased. He remarked that even <br /> though he feels that he could be fair and objective in considering this <br /> 382 <br />
