November 18.2005 <br /> Roll was <br /> called with all council members voting yes except Council <br /> Member Gipson who voted no and Council Member Overstreet who was <br /> excused. <br /> Motion carried. <br /> Moved by Council Member Nielsen,seconded by Council Member <br /> Stonecipher that approval of the proposed resolution be conditioned <br /> on the dedication of an easement to the public,or other device <br /> acceptable to the City Attorney,to ensure that the spaces listed in <br /> the application as semi-public open space will remain open from at <br /> least the hours of 7 a.m.to 10 p.m. <br /> Roll was <br /> u <br /> called with all council members voting yes except Council <br /> MemberKrell who voted no and Council Member Overstreet who wee <br /> excused. <br /> Motion carried. <br /> Moved by Council Member Nielsen to amend the motion stating that <br /> with regard to the construction of the esplanade,condition no.15 <br /> control all other conditions of the development agreement. <br /> Following further discussion,Council Member Nielsen withdrew his <br /> amendment. <br /> Moved by Council Member Nielsen,seconded by Council Member <br /> Stonecipher to amend the motion stating that the development <br /> agreement shall be modified to Include a provision as follows:the <br /> City of Everett may,using an appropriate public process,determine <br /> the location of a pedestrian access structure to connect the North <br /> Marina Redevelopment project to a suitable location near Grand <br /> Avenue,and upon such determination,the Port of Everett shall <br /> locate and design such portion of the structure that will exist west of <br /> 385 <br />
