February 14,2007 <br /> COUNCIL BILL NO.0701-06 <br /> THIRD AND FINAL READING: <br /> AN ORDINANCE creating a special improvement project <br /> entitled, "36.' SIreet/BNSF Rail Line Non-Motorized <br /> Improvements",Fund 303,Program 076,to accumulate all <br /> costs for the improvement <br /> Moved by Council Member Hatloe,seconded by Council Member Nielsen <br /> that this is declared to be the third and final reading of Council Bill No. <br /> 0701-06. <br /> Bob Buse,4005 Nassau Place,representing Smith Street Mill,stated that <br /> they are the only landowner in that crossing and have properties on both <br /> sides of the freeway. The only access between the two properties is <br /> under the freeway bridge.He was concerned that the design of a project <br /> could negatively impact his properties.He requested assurance that he <br /> be involved in the decision making. <br /> Dave Davis answered that this ordinance just sets up the improvement <br /> fund and no design efforts have started. He recognized that property <br /> owners who adjoin city tight-of-way have rights to access their properties <br /> and will make sure the design accommodates that. <br /> The City Clerk was directed to call the roll for the final disposition of the <br /> ordinance. <br /> AYES: Roberts,Olson,Hatloe,Gipson,Nielsen,Stonecipher, <br /> Overstreet <br /> NAYS: None <br /> Ordinance No.2972-07 adopted. <br /> 51 <br />
