July 18,2007 David Flake.10704 840 Place W.,Mukilteo,applicant,stated that they have reviewed the Planning Commission and neighbors comments made at the May 15 hearing and have been working on revisions to the original site plan. He remarked that they are not ready to adequately portray those revisions for review tonight so he is requesting a postponement to the 2007 docket. Council Member Olson questioned whether the applicant has an unfettered right to request a withdrawal prior to final action by this body, and if so.shouldn't that issue be heard first and voted on before getting into the substance of what the applicant proposed and what the Planning Commission has recommended. City Attorney Johnston stated that his opinion is that Mr.Flake can withdraw his application. Council Member Stonecipher remarked that she had reviewed the record in It's entirety and that there was a lot of uncertainty on the part of the neighbors as to what the project was going to look like and It's impacts on the neighborhood. Moved by Council Member Stonecipher,seconded by Council Member Overstreet to remand this item beck to the Planning Commission,let it roll into next year's docket,and have the applicant work with the neighborhood and Planning Department to come up with a better communication of the plan. Intercity Way, spoke in supped of the Planning Commission's Plammendation to deny Mn.Flake's amendment to the Comprehensive Land Use Map. They cited concerns regarding environmental impacts,flooding.pollution,and traffic issues.
