January 30,2008 <br /> Council Member Gipson stated that if,as Council Member Olson had <br /> mentioned,the Salary Commission recommended eight months delay on <br /> the implementation,it wouldn't have an affect on the charter. He <br /> questioned why a motion would be necessary. <br /> Council Member Olson responded that staff has adopted a position that <br /> the effective date in the Salary Commission which is specified as January <br /> 1,2008 controls. He stated that he strongly disagrees with that <br /> aondusion. <br /> Council Member Gipson questioned whether they could Interpret the <br /> charter any way they wanted. <br /> Council Member Olson stated that he believes the charter is pretty clear. <br /> It says 90 days after Sling with limited exception end that limited exception <br /> is H a citizen should file a referendum with the requisite number of <br /> signatures to make that a city-wide election.That is the only exception <br /> provided for in the charter with respect to the 90-day effective date. <br /> Council Member Roberts stated that Council Member Olson had obviously <br /> done some research on this.He said that he had not and that this is the <br /> first time this has come up that he's aware of.He remarked that if there is <br /> a legal question as to the charter's interpretation,they should look at that <br /> question before an action is taken. <br /> Moved by Council Member Roberts,seconded by Council Member <br /> Stonecipher to table the matter and ask for legal counsel to weigh in <br /> on the subject. <br /> Council Member Olson stated that this is not a new issue.He remarked <br /> that staff was requested to look Into this Issue several months ago and <br /> that he had not received any clear direction one way or the other es to <br /> why the recommendation of the Salary Commission has not been <br /> implemented In the way the charter seems to provide.He cited 2.8,sub <br /> paragraph f,of the charter and stated that this Is not malty a legal <br /> question any more,but a political decision and that's why it's back to the <br /> body so that they can direct staff to make a decision. <br /> 28 <br />
