June 25,2009 <br /> City Aoomey Jim Iles stated a correction is necessary regarding the <br /> agenda and cover sheet.The correct RFP number should be 2007-013. <br /> Pursuant to city ordinance the RFP coordinator did send out intonation <br /> that this bid award would be considered today.Yesterday a bid protest <br /> was received from Hansen's Towing which is now before the city council. <br /> The council has a number of options:set the entire maser aside;consider <br /> the protest at this time or eta later time and once the protest has been <br /> considered then determine how to proceed.The legal depadment has <br /> reviewed the bid protest and it does not involve any legal issues or issues <br /> that would require research on behalf of staff.It is the recommendation of <br /> staff that the city council proceed with their hearing of the RFP award and <br /> in conjunction with that take testimony on the bid protest itself;and at the <br /> conclusion of receiving public comments a determination would be made <br /> on the bid protest itself.Then dependent upon that,that would determine <br /> s the award is made or not <br /> President Nielsen stated that an option as council president is to refer this <br /> maser to the city council as a whole to be considered at this time. He <br /> asked if anyone wished to speak against that.No one responded.So the 1.. <br /> protest wig be referred to the council as a whale and will be considered in <br /> conjunction with the hearing. <br /> Council Member Gipson asked if this proposal is time sensitive. Greg <br /> Lineberry,Police,answered that d is not.There is a current operational <br /> procedure in place. <br /> Deputy Chief Greg Lineberry,Police,provided an overview of the changes <br /> of the towing and impound ordinance leading to this request for proposals <br /> (RFP).Last year the police and legal departments proposed changes to <br /> the towing and impound ordinance prompted by numerous complaints <br /> from citizens regarding what they believed were end <br /> unreasonable <br /> approximately <br /> onable towing fees.The police department makes <br /> 2,100 <br /> impounds per yearunder many situations. Under the previous <br /> ordinance the police department licensed qualified towing companies to <br /> be one rotation list. With that system neither the city nor the police <br /> department regulate what the towing companies charge which leads to <br /> complaints from citizens.The persons paying for the tows are not able to <br /> shop for the best rate and the towing charges vary widely between tow <br /> companies.A chad was shown depicting various scenarios and the fees <br /> 193 <br />
